    In which case, your ultimatum has little chance of being successful and you'll end up pulling out.

    Unless it's already arranged, your vendor's chances of getting the tenants out in three days in response to your demand are slim and none.

    You might as well pull out now, if that's the case.

    I am just asking for exchange and we can set the completion date 5/6 weeks later.

    He told me in the start that he will be moving with his brother or daughter house upon sale and will complete his next purchase from there.now he is just sitting right and telling me different story .

    I feel I am being used ...

    simple thing for him if he want to sell than he have to break the chain ...

    He can go for renting or his relatives like he told me before ..also he can have 5/6 weeks after exchange.

    Until exchange I have nothing and I don't want to be in this uncertainty any more ...

    Better to be clear now ...

    As has been said, no-one should exchange contracts on a let property until after the tenants have vacated.

    You cannot guarantee they will move out before the agreed completion date if you exchange while they are still there.

    Very amusing: I'd ignore this for the moment BUT I think you can still sue landlord for up to 3x deposit..

    It doesn't matter what he calls it or what the paperwork says, it is a deposit & you can sue him.

    Once you've moved into purchased house then sue him. You've up to 6 years from when he should have protected it to sue him. Shelter website has advice on what to do..
