    You have made a big mistake OP buying a 21 year old car without an MOT. Once it had got its MOT (dodgy or not) why didn't you take it for a test drive? There are many cars with current and even new MOTs that most sensible people would not pay money for.

    Buyer beware I am afraid, you have no comeback for a private sale.

    Perished tyres and rotten floor/sills don't need a genius NT to find. The issuing VTS will crap themselves if the get a visit for this kind of negligence.

    Remind us, is an older lady better than a younger one? In terms of car buying of course....
    and can any car that old be discribd as showroom?

    Perished and cracking tyres aren't an MOT failure unless the cracking is severe enough to expose the cords.

    Sills rusted through also aren't necessarily an MOt failure depending on exactly where the holes are in relation to suspension, seatbelt, steering and brake mounting points.

    Any tester with sense would have included them as advisories (CYA) but they're not required to.

    the first think you should write in any advert and garuanteed to sell any car for top money
  • I have said this before, but do not take it another garage for an MoT - All that is going to do is cloud the issue even more, especially if your plan is to then go to dvsa. Not only will you be getting your regular testing station involved but that also decrease the chance of discipline on the original station.

    I would;

    Go straight to an appeal and let dvsa decide what is right or wrong. Not that it is going to help you in the sightest with the car, but if the mot station has done wrong they will be disciplined accordingly.

    Or do what others have said, go and see your regular tester and ask if the items you are worried about are in fact a definite failure. If so head back to the original testing station and deal with it that way. Obviously this doesn't involve dvsa but it might result in some help to getting the actual problems on the car sorted.
