Advice needed for faulty cot

Hi,

Four years ago I bought a cot for my son I had no problems then put it away. 6 months ago I got it out again to use for my daughter. When she was 10 weeks old I was taking her out and as I did the base gave way. On closer inspection I saw that the pins were not secured properly and must have been like that from when I bought it, in fact a couple were cracked (there is no way I could have done this).
I contacted the company and they said even though its an older model they will send me a replacement base to borrow sent next day delivery. And to send the old one back for repair. I agreed and thought nothing of it. This was back in June.
Last week I contacted them wondering about the progress of fixing my stand (want this one back as the colours don't quite match). The lady said she would get back to me once she had spoken to the warehouse. Today she rang me to say they cannot fix my original stand as its an old model, but I can carry on borrowing the new one for as long as my daughter needs it and they will send me my broken one back.
Not sure where I stand as that leaves me still with a broken bed. I would keep the stand they've given me but it's a slightly different colour. I think they should give me a whole new bed if they can't fix it considering that my daughter could have hurt herself, but I don't know if thats within my rights after so much time.
I bought this bed from a well known reputable company for over £300 and I was hoping to use it again one more time ;).
Any advice please I would be grateful.

    1. Your daughter did not hurt herself, so you do not get compensation (a whole new bed) for things that might have happened.

    They have given you use of a cot until your daughter no longer needs one.

    You can bin the broken one.

    What more do you want? Its a 4 year old bed so its not as if you could have sold it on for money once it was used, or if you did the amount would be negligible after 4-5 years.

    No you do not have the rights to a whole new bed. Your son used it fine for however long, and you have a loaner cot for your daughter (albeit it a slightly different colour, which is obviously awful...)

    As it is over 6 months you would have to prove that it is inherently faulty by an independent report, they then have the option to either fix, replace or refund, but they have the right to give partial refund for the four years use you have had it. They have gone over what is right so far in giving you an alternative base and they have agreed for you to use long term. Don't think or bring up what might of happened, it didn't

    My mates kids weren't traumatised by driving around in a polo harlequin, so I doubt your daughter will be troubled with a mismatched bed.
  • Wow im really not bothered about the colour difference temporarily its just not what I paid for...really thats minor, the base however is different and doesn't fit flush to the bed part.
    Yes I know my daughter is fine and I am very thankful for that.
    But its not fit for purpose which I thought you had a certain amount of years. My son used it for 3 months and my daughter used it for 10 weeks, I know its 4 years old but surely expecting it to last more than a few months isn't too much to expect.

    Your son used it and did not fall out, and your daughter has also used it.

    Clearly it was fit for purpose.

    The SOGA act allows you 6 years to pursue a remedy if an item is faulty, however after 6 months you have to prove that the fault was there from the cot being made. After 4 years, being used, packed away, used, and sent to a company there have been a lot of variables which could affect it and I would imagine it would be difficult to get a report which states something is inherently faulty after this year. You can however always try.

    If the company did then decide to refund you they would take into account the use you have had, aka 4 years use of a cot (the fact you only physically used it for 5 months doesnt matter, you have had use of that cot for 4 years.

    Don't like the sound of this design. All the cots I had had a base that rested on a ledge. No way it could fall out .
    But then ,I am ancient ..

    Have you tried googling for a review of this product.

    A lot of them now do sit on pins so that you can adjust the height of the base. You have it set high when they are small so that you don't have to reach right over to pick them up, then you lower it when they are able to stand to make it more difficult for them to try to climb out.
