Initial Parking Eye appeal rejected

Hi,

I'm the registered keeper of a vehicle that was deemed to be 12 minutes over the allotted time at an Aldi car park and subsequently received a parking charge notice from Parking Eye.

I sent my initial appeal via email which was based on info I obtained from here and I've now had a letter back saying it was unsuccessful.

I've read through some of the letter on here but they seem very case specific.

I've got the rejection letter scanned in but i can't see how to add it to the thread at the moment.

Can anyone help with my POPLA appeal please?

  • Loads of examples of POPLA appeals available from the NEWBIES thread. They are not specific at all, but based on the usual winning points, which are pretty much immaterial of the events of the day. Use one of them, concentrate on the legal points.

    clearly you haven read the NEWBIES sticky thread at the top of this forum

    if you had, and specifically read post #3 , you would see the link leading to dozens of popla appeal examples you can adapt for this, especially as there have been hundreds of PE appeals for this and other supermarkets already

    and welcome to Moneysavingexpert.com.

    As mentioned above, there is a sticky thread for new people to read.
    Scroll down to Number three and have a good read.

    I know this takes alot to get your head round, especially if your also trying to navigate for the first time on Moneysavingexpert.

    Even though the newbie sticky has all the information you need, we are also here to help, so please feel free to ask any questions you have here.

    Once you got your head around everything look at drafting a letter from pne of the templates relating to Parking Eye.

    Although not new to Moneysavingexpert, I was in your position a few months back. Take a breather and read, as reading is knowlege. Please make sure you come back. Good luck so far

    I've read through some of the examples on the popla sticky thread and I guess what i was trying to say was there are only 3 for Parking Eye and each one has unique circumstances written into the letter.

    I understand I would need to remove them, I guess my question should of been if I do, would the appeal still be suffice.

    The most relevant template is PARKING EYE - OVERSTAY IN A FREE CAR PARK

    If i had to relate it to my situation then here's where I get a bit confused....

    Point 1. removed about it being dark and nobody parked there as it wasn't dark and there were other cars. (i'm ok with this one)

    Point 2. mentions visiting adjoining shops i.e. farmfoods. Not relevant because there was no farmfoods or adjoining shops.

    So do I remove the whole of point 2?

    Point 3. This again mentions the fact that it was dark and is therefore not relevant so do i remove point 3 as well?

    Point 4. Parking Eye's evidence did show an arrival and departure time alongside images.

    Again do I need to remove this?

    Can you see my point. If i removed all the non relevant info I would have nothing left.

    Confused???

    Can someone help please?

    An 'arrival and departure time' in moving traffic is not a period of parking and nor does it discount the possibility of a double visit, when appealed by the registered keeper who was not necessarily even in the car and is entitled to raise the issue of ANPR double visit scams. I don't think you realise PE Notices always show an arrival and departure time, so why would anyone remove a section related to that, in the template for all PE appeals? You shouldn't be removing whole sections, only irrelevant sentences or words such as it being dark, or visiting Farmfoods.

    I've edited the letter from your link and will use that.

    I won my appeal guys :)

    Reasons for the Assessor’s Determination
    It is the Appellant’s case that the parking charge notice was issued incorrectly.

    The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.

    Accordingly I have no option but to allow the appeal.

    Thanks a lot for your help guys and big thanks to everyone on this forum who gives up their own time to help people like me beat these parasitic companies who try to extort ridiculous amounts of money from hard working people!
