Parking Eye appeals process

Hi,

After reading through the stickies and the guides on MSE I made a parking eye appeal online last Friday using the shortened template on the forum. I have not had any acknowledgement of the appeal and received a parking charge notice reminder this morning. The £60 reduced charge period expires tomorrow.

I was 24 minutes over the 4 hours I had paid for (although we did hang around the car park longer then necessary after getting back to see no ticket on the windsceeen) but as this extra time would have cost less than £1 the £100 charge seems excessive to say the least. It was all on holiday so no ticket to prove how long we paid for, and no possibility to go back and check signage etc. 2 friends also received tickets for the same car park on the previous day.

I have a couple of queries:


  • How long does it take to hear back from an online appeal?
  • By appealing have I renounced my right to the discounted charge?
  • I recall the ticket did not give a leaving time or even state how long we had paid for, just the amount and time we had paid it - is this allowed?
  • In your experience is this charge likely to be overturned by POPLA?
These things really stress me out so if it is a long drawn-out process I would almost rather pay up and move on, but I realise by giving up this means Parking Eye win and will carry on taking advantage of others who unlinke me may end up in financial difficulty by having to pay.

Any advice gratefully received...

    According to the BPA Ltd. Code of Practice they must acknowledge within 14 days and decide within 35 days. If you want belt-and-braces, send your appeal again by snail mail (stating that it's a copy of an appeal already submitted on [date]) and get a free proof of posting from the Post Office.

    "Right"? Who do you think they are? They can neither confer nor withdraw "rights". Your most important right (which is not in PE's gift) is the right to pay nothing.

    They make up their own rules. Don't worry about it, it's not important to getting this quashed.

    1. They have 35 days to deal with your appeal. You will hear from them.
    2. Don't worry about phoney 'discounts' as you'll be paying them SFA as you've found the right place and people to help you successfully through this.
    3. Times shown on the ticket you purchased is irrelevant; it will count for nothing from here on. Mitigation is not considered by POPLA.
    4. There's not much else left in the process for you to do other than copy and paste a PE-related appeal from the sticky list #3'How to win at POPLA' and with one of those PE throw the towel in and you win by default.

    Did you get an automated reply to the appeal like this one below.

    Note they are saying they will reply within 14 days --- nearly up for me , but I understand they legally have up to 35 days to reply.
    Just be safe and send a copy in the post with a proof of posting:)

    they have 14 days to acknowledge the appeal and 35 days to reply under the BPA CoP, but those are guidelines and the word "legally" does not come into it

    PE don't acknowledge appeals as such (that email is the acknowledgement) so as Redx says, they have 35 days and more to come back on or before some time in early October with the POPLA code.

    EVERYONE HERE WINS. PE DROP OUT AT POPLA EVERY TIME THEY SEE OUR TEMPLATE POPLA APPEAL. NO-ONE SHOULD BE CONSIDERING THE 'DISCOUNT' BRIBE!

    A quick update:

    After submitting the standard template short online appeal followed up with a paper copy in the post I received a letter from Parking Eye saying the charge has been cancelled. :j
