Argos card PPI

Has anyone had any luck reclaiming PPI on an argos card. Tried but got rejected but wondering about trying again as a new claim as mentioned in email tips from MSE. What do you think?? Am I wasting my time. I genuinely believe I had a case and shouldn't of given in so quick last time.
Appreciate any advice

  • You only have one chance to complain. I don't think MSE suggests making any new complaint unless the financial institution concerned is one of those re-opening complaints anyway.

    Did you refer your original complaint to the Ombudsman? Did you take this insurance prior to January 2005?
  • Oh guess I misread. Got my hopes up for a minute. Took it out before 2005 and after first rejection stupidly gave up. Never got as far as ombudsman. Oh well serves me right for giving up so quick.

    If you bought the insurance from Argos prior to January 2005 then this was pre-regulation, so even if you had wanted to you had no access to the Ombudsman.

    Forget about this, you have already done everything you could have done.
  • I was rejected by Argos when I called them, but despite my previous repeated attempts to cancel the "insurance" and having been refused, when I called on that day to complain, the person at the other end at Argos suddenly offered to cancel the policy!

    I told her I was going immediately to the FOS, which I did, they sent me forms and asked for any documents I have regarding when the policy was taken out and by whom and charges etc so I produced copies and sent them all back to the FOS. It is taking a while because it's gone to their legal dept but I have heard back that they confirm I do have a case against not Argos but the underwriter Allianz and they have advised me that I will be hearing further. So here's hoping and I hope this encourages anyone else not to give up! Thanks MSE, without this site I would never have guessed I could complain about that.

    Don't get excited.
    The FOS are trying to get the underwriters o accept responsibility.
    What it actually means for you is that you will wait for probably 2 years fater which the FOS will say they can't find anyone to accept responsibility and you will still have nothing at the end of it.
    The seller has the responsibility for the sale, not the insurer unless there is a direct link between them. The FOS are trying to find a link.

    You don't "claim PPI", you have to complain that the insurance was somehow mis-sold to you and give valid (preferably verifiable) reasons.

    If you have such a valid complaint, you write to Argos who then have eight weeks to consider your complaint. Do note that Argos were not regulated prior to January 2005, so if you bought the insurance prior to that date Argos can decline you on that basis alone.

    To taff and Moneyineptitude I am totally aware of my position, if you recall I did end my original post by saying "here's hoping". I just want these companies to have redress, whether I get money or not, whether I have to wait for years or not, i want them to have grief, they refused to cancel when I asked them to previously and I was told when I took out the card that the insurance was part of being an Argos card holder. If the FOS make them examine their practices then that's all I ask for. Any money back would be a bonus.

    You really think a referred complaint is giving them "grief"?

    Argos have already rejected your claim because it is pre-regulation and FOS can do nothing because of that.

    FOS are now simply investigating the possibility that the underwriter might take responsibility, but the chances are slim.

    Argos' involvement has already ended (so no "grief" for them) and Allianz will receive a letter from FOS asking them to agree to accept liability for any mis-selling. Allianz are under no such obligation and, again, will hardly suffer "grief".

    The £850 fee FOS charge does not apply to pre-regulation complaints.

    The only reason you will wait for an age for a final rejection of your complaint is that FOS are swamped. I promise you that your complaint is simply in a queue for a case handler to look at it. Your complaint is not with any "legal department" at FOS, nor does it need to be. FOS never discourage anyone from making a complaint and their call centre staff are notorious for telling complainants that they "have a case" regardless of the circumstances.
