Worksop Priory Shopping Centre

PLEASE SEE WORKSOP GUARDIAN WEBSITE AS I AM NOT ALLOWED TO POST LINKS, SEARCH WORKSOP PARKING EYE

2 Articles are in this weeks local rag about our good friends Parking Eye

This car park is starting to get a lot of press recently and to be quite frank it's the most ridiculous car park I have encountered in my life.

For those of you that don't know - This car park is a through road, cameras are set up on the entrance and there is no other way around it due to one way streets. Additionally as stated in the article there are loading bays! Basically your have a better chance of getting a charge than not getting one :j

I took on and beat my claim at this car park at POPLA (thanks to help from you guys) - But how can they put in an article that Parking Eye use a fair appeals process

The other point that infuriated me was the statement from the shopping center!! When I emailed them I received a response which I will find and post later saying - "We don't lose appeals at this car park and I wouldn't go to the effort of appealing to the company and end up paying more" :rotfl::rotfl::rotfl:

Do post a pic of that letter - name and shame and show us their rubbish. How dare they think a pariah of a parking firm is more important than a customer?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hi there, please ignore the username as I'm no longer happy got a letter fine £100, discounted to £60 WOOOOW that's parking eye so generous! Serious business... When I park up I put into the machine slot £4 hoping get 4 hours parking because knew I have lots to shop and do around the priory but the machine printed only 3 hours ticket - 3 hours actually cost £2.50, gave me no change means I loss the £1.50!! Worse I tried to rush back to the car park to add more money after 3h 20mins but the machine took my money (£1 thought pay for what I parked I'm that honest) but no ticket printed :-( no refund for the £1 or £1.50 either!!! Now how to appeal? The machine took my money but not leave a word and no proof provided by the machine that took my money! now how to appeal?

I challenge this 'PCN' as keeper of the car, on the following grounds:

    a) The sum does not represent a genuine pre-estimate of loss. It is a disguised penalty and not commercially justified

    b) As keeper I believe that the signs were not seen, the wording is ambiguous and the predominant purpose of your business model is intended to be a deterrent

    c) There is no evidence that you have any proprietary interest in the land
    d) Your 'Notice' fails to comply with the POFA 2012 and also breaches the Consumer Contracts (Information, Cancellation and Additional Payments) Regs 2013

    e) Your ANPR is not maintained or in correct working order. Furthermore the system is not operated in a reasonable, consistent and transparent manner

The purpose of this communication is threefold:

    1. Formal challenge
There will be no admissions as to who was driving and no assumptions can be drawn in the absence of evidence. As such, you must either rely on the POFA 2012 or prove beyond any doubt who was driving - or cancel the charge

    2. ''Drop hands'' offer
I calculate that we have both incurred some nominal costs - under £15 – so this is a formal “drop hands” offer. I remind you of the duty to mitigate any loss, so withdraw the charge within 35 days without further expense and I will not pursue you for my costs

    3. Notice of cancellation of contract
I hereby give notice of withdrawal from this alleged 'contract' which was never properly offered by you and certainly was not expressly agreed. This 'contract' is hereby cancelled and any obligations now end. If I decide to use POPLA, then the contract ends immediately on the date of their decision (whatever the outcome) so my notice of cancellation still applies. The Consumer Contracts Regulations apply now to every consumer contract, save for a few exemptions, which parking contracts are not. It is the will of Parliament that express consent is obtained for consumer contracts - not implied consent - and that information is provided in a durable medium in advance

This constitutes the entirety of my challenge and nothing further will be added. You must now, within 35 days, EITHER (i) accept my challenge and notify me that the charge is cancelled, OR (ii) reject my challenge, send me a PoPLA code, and suspend any collection activity pending my PoPLA appeal

By replying to the challenge you are acknowledging receipt and acceptance of points 2 and 3 above. If you decide to persist with this unwarranted threat, I will be put to unnecessary expense and hours of time in appealing or defending this matter. As such, you will be liable for my costs and a pre-estimate of my loss - and in contrast with yours, mine is genuine - is that this sum will be likely to exceed £100

I have kept proof of submission of this challenge. I look forward to your considered reply within 35 days
They will cancel the charge within 14 days.

And do start your own thread, please - helps the helpers to keep track of things.

"... do start your own thread" Is there anything I missed and anything else I should do now?

Write to Worksop Shopping Priory and tell them exactly why not only you, but also members of your family, relations and any friends you can persuade to follow your example in refusing to shop there ever again.

What you've done is good for the time being; it should result in a cancellation from PE. If it doesn't and your appeal is either rejected or you are asked for more info by PE, that's the time when you really need to start a new thread of your own.
