how do I get my money rather than a replacment

i have bought a Jawbone Up 24 and it failed after 2 months. I received a replacement which also failed after 1 month. I have asked for my money back as I dont want another failure but they have said I am not entitled to a refund. What do I do as I don't want to have to keep sending these things back?

  • The retailer under the SOGA has the right to decide if to repair, replace or refund once the goods have been deemed to have been accepted (which would be the case after 2 months).

    Realistically one failed replacement isnt really sufficient to give you much grounds for demanding a different resolution. Why not discuss switching model with the retailer though instead?

    Unfortunately, you probably are not entitled to a refund.

    If the seller must provide a remedy, that could be a repair, replacement or a refund.

    If a refund is chosen, then it could be a partial refund to take account of the use you have had.

    You cannot force a seller to provide a disproportionately costly remedy, which effectively means the seller chooses the remedy.

    The seller must provide the remedy without causing significant inconvenience.

    Currently, the law is not clear how many times a repair/replacement can be made before a refund is the only remaining option.
