Claiming after someone has died.

My ex husband died December 2011 and after sorting my paperwork recently I realised my pension taken out at the same time as one he took out pays out on death. So as his next of kin my children should benefit from this. However, His mum who is also now dead arranged his funeral etc.
He died in spain, he had gone to live there after changing his name by deed poll, (long stupid story). So all details I have say his original name, he died under his changed name, his tombstone has both. I do not have a copy of death certificate, but that will have new name, nor his deed poll.
Any ideas how I get Phoenix to pay out on this claim. Short of digging him up and doing DNA testing on him I am at a loss. I don't know who to ask next, I have written to all local solicitors re deed poll and to registrars and commonwealth registrar re death certificate. I do not want to start paying for info without knowing if there is even any money in the policy, currently they wont even tell me that.

How do you know there is money still there? How do you know he didnt have a named beneficiary for it who received it or if the spanish equiv of an executor didnt deal with it already.0

Phoenix would not be asking me to provide information if it had already been claimed, nor would they have given me the policy number. No one knew he had this policy it was an old pension policy, I had not realised they paid out on death until I read my own. He certainly did not have an executor in spain. Sudden death. No will.
