all dealt with in the NEWBIES sticky thread

no you do not have to name the driver, but they can then chase the RK

if they rejected your appeal as RK, they should have given you a popla code

Redx, they're not requesting the driver's name and address, they're requesting the appellant's name and address, which she evidently did not give.

Lizzy, you will need to give them your name and address if you want the appeal to progress (and if it doesn't progress you can't win it). Just be careful, as always, not to say who was driving.

none of that was apparent to me when I read post #1

I read it as an RK appeal and the standard excel or vcs response of asking the appellant to name the driver in the appeal acknowledgement

She said "they have requested my full name and address" not "they have requested the driver's full name and address".

to me its ambiguous, as she hasnt said in what capacity the PCN was appealed

I took it as a RK appeal in which case they dont need her name and address as they already have it

clearly you read it in a different manner than I do, which is your preogative to do

I read it as an RK appeal where they have her name and address from the DVLA in which case she has no obligation to give them her name and address nor any drivers name and address either

I read what it said. I generally find that works best.

and I read it my way, which is the way I answered it

I believe I am correct, clearly you have a different view, well tough as I wont be changing my replies - sorry

this reads to me as an RK appeal where they already have her name and address , so not required to be given

its also a typical appeal response from excel to try to get the drivers name and address in the appeal response, which goes against the BPA CoP and has been complained about many times

so if she is appealing a pcn that already has her details, there is no obligation to give them again, or anyone elses

Thanks, realised that in order to progress the appeal they will need to contact me so have forwarded on my name and address as keeper

Thanks. It seems that you wrote what you meant to write and I understood it as you meant it to be understood.

yes you can do that but IF they already have the details from the DVLA there was no need to provide them again, usually they are trying to entrap you into naming yourself as driver, or give the name of the driver

only give them what they need to know , thats my motto
