Broken Shower

Hello,

I bought a walk in shower, complete with in built thermostatic valves in April 2013. It was installed and has worked up until now.

The thermostatic valve has broken off, causing water to flood out. We have had to isolate the water supply to the bathroom.

The shop in question was selling this brand new via eBay and offered a 25 year guarantee. The guarantee only suggested that there is a postage charge for parts.

I have contacted them and they want £35 for the new valve. This may be petty but being a guarantee I wasn't expecting to pay this.

What are my rights?

  • Where is the vendor based?

    Assuming they are in the UK then its covered by the SOGA and so as its over 6 months old so its up to you to prove the item is inherently faulty and its not caused by miss use or acceptable wear and tear. This would normally be done via commissioning an engineers report but you'd first try arguing more with the vendor before having further outlay for yourself.

    Have you actually read your warranty to know if there is an excess to pay?

    Whose guarantee is it? The manufacturer's or the seller's?

    Which of those have you spoken to?

    I would also expect a shower to last longer than one year, but faults occur.

    It is a sellers guarantee, they refer to it as our guarantee.

    And thats where the sales of goods act comes in but due to how long you've had it to follow it properly its up to you to demonstrate that this is a fault with it rather than, for example, you've dropped something on it that broke off the valve

    I was assuming the vendor is still using ebay to advertise his (apparently) worthless 25 year guarantee.
  • The vendor is indeed! And I have found out they actually own the manufacturer.
