CP Plus notice

I received one of those so called parking charge notices last week titled Legal Action Pending
They stated that this was the third time and I'd ignored the previous 2
This is not true because it's the first I have received
I have never had anything go missing in the post before so I cant see how 2 items should go missing a month apart
Could this be deliberate so I'd exceed the 28 days to appeal?
They are now asking me for £120 to make it go away
I sent the template letter from this forum anyway and kept a proof of posting

Has anyone else received such a notice out of the blue saying that they's already sent 2 notices previously? I'm wondering if this is more common. I smell something fishy about it

Also does anyone know how long it usually takes to get a reply to the template. Its been a week since I sent it and can't say I'm not worried

    Yep, happens all the time.

    No need to worry about CP Plus, utterly toothless. It's all lies about legal action. In fact, come October we'll be able to sue them for issuing misleading and aggressive letters like that.

    I'm not really sure what you mean. In my case it was a motorway service area

    If it had beena railway station, then you would have a stronger argument for no keeper liability since the land is not relevant for POFA 12 and the Train Operating Companies would only have 6 months legally to chase you.

    However this is an MSA , which is a different thing. However also good news as there are clear ways of appealing to MsA.


    Ok to answer your questions which I realise we haven't.

    The PPC have up to 35 days to reply to your appeal. It is still early days.

    Yes sending the letter without the two previous is a common tactics. There have been several threads on this, but you would have to do a forum search for cp plus to find them. In each case the advice is to email the information along with a copy to BPA complaining about this.

    There are too many examples where for the same address, not one, but two letters go. Issuing from this and only this company. It happens too often to be a coincidence.

    So post 6 of newbie thread has email address for Steve Clark for the complaint and post 3 has the link to examples of MSA POPLA appeals.

    You might well need Steve Clark to get involved so that you get a POPLA code pr they will simply say you were out of time for it. So get that email to him before you get a response from them!

    It's irrelevant because it wasn't a railway car park, but most railway car parks are covered by byelaws which means that CP Plus can't hold the registered keeper liable for parking charges, only the driver.

    CP Plus at a motorway service area presumably means Moto. Moto has a (not publicised) policy of cancelling charges where motorists overstayed for safety reasons i.e. they needed to rest/sleep, so try contacting them. Obviously explain that this is the first you've heard from CP Plus otherwise you'd have contacted Moto earlier.

    I will store that snippet of info away, I didn't realise CP Plus inhabited Moto service stations. The CEO is on record for saying that isn't he?

    Can't remember who said it but they have stated it's their policy, and we've seen several here that were cancelled when the motorist told Moto that they had overstayed for safety reasons.
