Car Accident - Responsibility Dispute

  • Get dash camera. If you had had one it would have shown that you were stationary at the time of the accident.
  • As an update I went to the local police desk to see what could be done. After some explanation of the situation (and reference to the Traffic Division) it was agreed that the other party was in contravention of Section 170 of the Road Traffic Act in refusing to give me their VRM. They rang her whilst I was there and after a brief argument over responsibility on her part she eventually handed the information over.

    It then got a bit interesting as I assume from having been contacted by the police she must have then got in touch with her own insurance company to state her case to them. The next morning I had a phone call from them to say she was still arguing responsibility, but having listened to the details that she had given them they deemed that she was wholly at fault and as we were the innocent party they would meet the full cost of all repairs.

    My faith in the insurance process has been somewhat restored, if not quite my faith in human nature with the antics of the other party.
