I delt with SmartParking all wrong...am I doomed?

Hi guys...
Ive never had a PCN or even heard of these companies before so when I received a PCN for overstaying at ASDAs carpark a few weeks back I basically did everything that the NEWBIES thread tells you not to do :( I contacted asda direct and explained that I was a regular...helping my elderly mother do her shopping etc..didn't know I had gone over time so therefore did not keep receipts..they gave the line they 'cannot help with this' so I used the online appeal form on smart parking website...which means they now have my name (car is registered to my husband)
I feel so stupid!! I didn't think to look on here till a friend recommended it :(
Am I doomed to have a rejection and a shed load of hassle?? :(

    Oh dear, you have probably decreased your chances of beating this company by 1%.

    all is not lost, so worry not

    either the driver will receive a pcn in their own name, or smart will issue an NTK to the RK

    they may cancel if you used the template , and in any case asda should cancel if you complain loudly enough and to the correct people at asda

    so you await the response from SMART (within 35 days), , if necessary use the help on here and post #3 of the NEWBIES thread to appeal to popla, and win

    so dont worry, with our help you wont pay a penny

    in the meantime complain to the asda CEO , seeing as the local shop didnt help
  • Hang on, if the op has appealed already she should get a popla code when that is rejected. Otherwise a complaint to the BPA and DVLA is next.

    correct, but that would mean getting a pcn in her own name , if she is the driver (or a popla code as you say)

    but neither you nor I nor the OP knows if not so smart will send an NTK to the RK , especially when these PPC,S regularly say they havent received any appeal at all, or pass it to DRP etc

    nobody knows what will happen now, until it happens

    So basically now I just wait again to hear anything?
    Or should I contact asda again in the meantime? (how do I get a ceo?) I just used the contact options on their website

    check the NEWBIES STICKY THREAD AT THE TOP OF THE FORUM

    It has explanations for acronyms, explanations on various topics and links to threads and posts containing complaint email addresses etc

    if you dont look, you wont know , its all in there, so spend the time looking and researching etc

    Read the Sticky thread for NEWBIES where all the acronyms are explained, and all the information you need on how to beat this can be found. Your first appeal WILL be rejected but the parking company MUST supply a PoPLA code. With that code and help from the volunteers here you will beat thus and cost the not so smart parking company money.
    Make a cuppa, start reading, and relax.


    Meanwhile complain to ASDA again only longer and louder. They are the principle so are liable for the actions of the parking company they have employed. Do not be fobbed off. Just keep going higher up the tree until you get a result even if that means contacting the CEO as already suggested.

    @OP - it's not clear from your posts exactly what you've received (or who has received, for that matter).

    Was this a windscreen ticket? or
    Was it a letter in the post with images of your car (and number plate) entering and exiting the car park?
    Date of parking event?
    Was the event in England/Wales?

    You need to write to the Chief Exec of Asda to complain about the unhelpfulness of his staff in resolving your issue and that you are minded to pursue Asda under the Equality Act 2010 given your elderly mother, who needs additional time to shop, is covered by this Act. You might see a rather more helpful response from him.

    Andy Clarke is your man; mark the envelope 'Private and Confidential' which should get it at least to his PA.
