Hi I really don't no what to do I am really stuck with this guy he is just does not care.
I bought my car in October 2013 for £3000 with a years premium warranty from a garage every thing was all good with the car until the 5 August 2014 when the cars brake failed while I was driving. I contacted the garage and the guy said bring it in and I will have a look he then contacted me saying that its the Brake Master Cylinder and is not covered under the warranty because its wear and tear even though its written in the warranty booklet I got at the time of sale he said no its not covered and said that it will be £250 for the part and labor so I said ok as I really need my car to go work he then comes back to me 5 days later and says the ABS module has blown as well and that is covered under the warranty I said to him ok so when do I get my car he says tomorrow I phone him the next day and there is a voice mail on his phone that he is on holiday for 5 days he didn't have the decency to tell me. when he come back I contacted him and expressed my concerns to him and just didn't care the fact that he has given bad customer service. Now I have been contacting him every day since then and every day the same old story by the end of the day your car will be fixed.
I did some research online about his garage and guise what there are 25 reviews about him were he has ripped people Trading Standards are on his case and some people have even taken him to the small courts he is a big bully.
I am a family man earning minimum wage really don't have the money to go to solicitors and so far in a whole month have spent £150 on taxis someone please help seriously I have also heard from the word of mouth the he is dangerous I don't want trouble I ust want my car.
Thank you

Visit his premises to see where exactly the car is and what its current condition is first. If he's been to small claims before I suspect he's a Ltd company abusing the Companies Act rendering a claim pretty much useless anyway.
I suppose the key is to determine what his intentions are and ensure you are not without the money and the car.
You don't need a solicitor to go to small claims court (moneyclaim.gov) - and I doubt a solicitors letter would phase him, so a waste of money if you ask me.0
