Hi All
First post. Am I right in that Parking Eye are currently putting all appeals to them on hold for Southampton Town Quay. It would appear that they are under investigation for improper use of POFA. I also understand that DVLA are investigating them for breach of code and that the ABP are also involved.
If this is the case will they still have the 35 day reply rule applying to them if they do not cancel or issue a POPLA appeal.
I do have a vested interest in this scenario as I have appealed to Parking Eye recently with a confirmation of posting and have not received a reply.

For once, this may actually fall under the BPA's "exceptional circumstances" where they can extend the 35 days. Though they do have to tell you this, and set a date by when you can expect resolution.If this is the case will they still have the 35 day reply rule applying to them if they do not cancel or issue a POPLA appeal.0 -
Received a letter from Parking Eye before I had time to write to them!! It states the following:
Parking Eye are currently awaiting confirmation from the DVLA and the British Parking Association concerning how appeals for Associated British Ports ought to be dealt with.
We will endeavor to respond to your appeal as soon as possible.
We can confirm that the parking charge has been placed on hold and will remain at the discounted value during this time.

The BPA Ltd. will of course find some weasel words to exonerate ParkingEye, but I fear that fudge is what we will also get from their buddies at DVLA.Je suis Charlie.0

I've amended this sentence from their letter to more accurately describe the situation. :cool:Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I wonder if I should contact the Echo newspaper as I'm sure they would be interested in this story. They ran an article a couple of years ago and they were fairly scathing then about Parking Eye and its sharp practices.0

Go for it. This might also remind them that ParkingEye is supposed to be under investigation regarding The Range in Southampton, but this seems to have been conveniently forgotten by DVLA:

Public highways are excluded as well as any parking places on public land which are either provided or controlled by a local authority (or other government body). Any land which already has statutory controls in relation to the parking of vehicles (such as byelaws applying to airports, ports and some railway station car parks) is also excluded.[/FONT]
[FONT=Tahoma, sans-serif]This is one area that is not open to obfuscation , ambiguity or manipulation .
The statute is clear , if bye laws are in force then it cannot be relevant land for the purposes of POFA .[/FONT]
