Unneccessary obstruction - fixed penalty

I got given a fixed penalty notice today for being an unnecessary obstruction. We have a part of the street where there is parking allowed. Along this street there is a closed down hotel with gates to the side which have been locked for a couple of years, I parked in front of the gates, there is no road markings to say I cannot park there, no loading bay sign and no proper sign either along the road. On the gate, there is a fire exit sign which the owners placed there but nothing official. People park in front all the time. Am I meant to obey someones plasticised sign they put up or just official road markings I guess is the question, lets face it, if there is a fire in any building then if you are parked outside, you could hinder any fire fighting. When we use to have a traffic warden round the town I asked if we were allowed to park in front of shops etc because some of the owners use to moan, he said if they wanted nobody to park there then they had to apply for that so that the road is marked for laoding only.

As this is not a private parking ticket, I suggest you pop over to pepipoo.com and post there as they are more familiar with these type of situations.

Unfortunately you have two options with a fixed penalty pay it or go to the magistrates court to argue it.

An police FPN for obstruction does not need any lines signs or anything it is simply the officers opinion. A FPN is an offer to pay and be done with it or go to court.
  • Will do, thanks.
