Buyng a property in Scotland

Good Evening All!
We are new in the country and have put an offer for a property in scotland after getting an AIP from Halifax. Property is in a desireble area. Offer verbally accepted on a Friday 16:00 at the valuation price. Mortgage submited on a Tuesday due to bank holiday on Minday.
Now (after three business days) the seller has come back to us with writen acceptance with a deadline of two days to complete the missives. I still dont have a final offer from Halifax andthey requier it by noon on Monday (today is Friday). Internet still showing the property as listed. Scam? Rip off? Trouble?
It feels like they are advertising the property whilst verbally accpeted imy offer.
Since verbal acceptance we have had 4 days with the mortgage application in. Another 2 days is completely unrealistic to get an answer from Halifax, considering i work as contractor. I feel like they have given up on the sale or want more money! Not sure how to proceed! I am really disgusted with the whole process.
Considering the dealine is unrealisic, do I have any rights in all this? Shall i just give up and search for a new property?
Any advice would be greatly apppreciated.
Cheers

Property still listed as it has yet to be sold. Not at all uncommon.0

Woah there. Time limits on missives fly by without anything drastic happening, I wouldn't worry about it - it doesn't mean they actually intend to remarket it on Monday afternoon. The sellers will know there's little prospect of you having a mortgage offer within five working days. Their solicitor will start chasing it up, your solicitor will tell them what the current state of play is with your mortgage application, and so it will go on for a while.
It's fairly normal for the property to continue to be listed until missives are concluded, anybody enquiring will be told it's under offer.0 -

Was this a WRITTEN offer, submitted by your solicitor?

Was this a written acceptance from the seller, or from their solicitor? If it came from their solicitor, it will have been sent to your solicitor, since your solicitor sent them the written offer.
If the written acceptance has an unreasonable deadline for conclusion of missives, as this certainly is, your solicitor should go back to the seller's solicitor. You shouldn't be involved.

Leave it to your solicitor. You DID hire an experienced property solicitor, didn't you?0 -

Yes! I did hire an experienced solicitor. Our offer was submitted by our solicitor. The letter came to my solicitor, but they just forwarded it to me friday after 6PM. Solicitor is off and mortage broker is off..... Back on Monday now.
I guess i will endure my worst weekend in life....:mad::mad:
I have ticked all the boxes from halifax, but being a foreigner everything is double checked. It will be just time consuming.
Thanks you all for the guidanc!!!!0 -
This is normal in Scotland, stop stressing.
Agents don't like to remove listings as they like to look as though they have lots for sale, very annoying when trying to buy only to find half of right move was sold!
If you want to check have someone else phone and ask for a viewing. They will be told it is under offer and no viewings available. The agent may ask for their details in case that changes, which is why they leave it up, to collect prospective buyers.0 -
Just keep fobbing them off, I have dragged out Missives for months in the past.
You still need a valuation, searches etc so Missives are a good bit away yet. The sellers solicitor will know this time limit is way to unrealistic and should put the sellers right.
Whatever you do, do not complete missives (not that your solicitor would let you) because once you do no matter what happens your bound by it. Make sure everything is in place first.0 -
Hi,
chill, you and the wee wummin just chill, have a glass of wineand chill, sit and make plans for your new house.
Things don't happen overnight, usually in Scotland once an offer has been made, house will still be listed, though 'under offer', thing is maybe the buyer will pull out, just let your solicitor sort it out, chill.
Hope youse are happy in your new home.0 -

(Googler agrees)

The OP cannot conclude missives independently of their solicitor, because the missives are the letters which pass between the two solicitors. The OP can't send a letter from his solicitor to the other.0
