UKPC - Parking ticket

Hi, I am new to the forum and after posting about my situation on another Forum I was pointed in the direction of the MSE Forum.


Sat 16 Aug
The driver
arrived at Asda to do the shop.
Having a 14month old son and pregnant girlfriend in the car the driver circled the child parking bays only to find that there were no spaces available.


The driver had a
passenger with a protected characteristic (EA2010) but does not have blue badge






After the driver had come back to the car the driver had PCN issued



Any advice on what next or what to do ?

    Barry on waiting for the NtK to arrive, then appeal using the appeal wording in the sticky thread by coupon mad. About the store is it a stand alone one? And is the parking smart parking?

    Sorry it's UKPC, so it's likely not Asda as they use smart, just do the appeal
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    The store was on a retail park This was a Private car park at Middle brook retail park Bolton England as we were shopping at Asda
    This may sound odd but I am un-sure as to what you mean by "Smart parking"
    Pay and display then no its a totally free car park

    he means Carry I think (probably a predictive text error)

    normally its wait for NTK from Smart Parking, as they tend to do asda car parks

    so he is assuming its smart parking , or you said UKPC which is unusual, but if asda dont own the site then maybe its UKPC after all for the actual landowner

    so in a nutshell

    wait for NTK from UKPC, the use the template and appeal

    its all covered in the newbies thread , and the flow chart in there too

    Smart Parking are Asda's national parking company, they use them in all stores they own that they feel they need them. The fact that there is someone else scamming probably means they are the leaseholder or its on a retail park of some description.

    Yeah that's right its a retail park and Asda just lease the building from what I was told having received an Email back from Adsa's CEO-team
    The information covered in the newbies thread , and the flow chart is there any chance you could post the links ? I aint having much luck with this forum and finding my way around ( yep I am new )

    First can you remove identifying information from first post, too much info that if a PPC reads, could be used .

    Secondly for newbie thread see my signature ( the bit under these words) . You will need to learn to navigate this forum for various reasons. Best start now.

    So simply say in first post, driver parked in disabled bay, passenger with a protected characteristic (EA2010) but does not have blue badge . PCN issued. Etc. Get rid of the medical details and word "I" please for your own benefit.

    if I am using the template from the newbie thread it gives me a number of options I am guessing I only put the one in what corresponds to my case ? ie A-B-C or D ?
    Do I include anything about EA2010 ?

    I would simply respond to the NTK with the appeal points in post 1 of the newbie thread. Sadly EA2010 seems to have little bearing at any stage of the process. So, a,b, c & d are what you go with.

    Where the EA2010 could come in useful is with the complaint you make if you haven't already done so to the supermarket when you go in and respectfully demand that they get the PCN cancelled as your passenger had a protected characteristic under the EA2010 and the supermarket could be said to be discriminatory in allowing this to happen in their car park!

    You are the fifth person to think they have to remove/prune the appeal points from the template appeal - why please? It doesn't say they are 'options' it says the appeal is 'suitable for all cases'. Not sure what to change in the wording to make people understand it is to be used in its entirety, every time.

    As for the EA 2010, forget it unless I have got this wrong.

    If you are saying the 'protected characteristic' was pregnancy then yes, it is - but only under the limited maternity protection section of the Act. Pregnancy is not a disability unless the passenger also had a disability - it does NOT entitle the lady to use a disabled bay. If you used a disabled bay just because you had a pregnant (able bodied) passenger and a toddler in the car then don't ever do that again (please).

    A parent & child bay isn't a right; it's a gimmick by Asda and other Supermarkets, didn't you know that's all it is? Means nothing and entitles parents to nothing at all, not a wide bay, nothing. Certainly not taking up a disabled bay just because the silly P&C bays are busy. Drop the lady & baby off by the trolleys and then park in a normal bay next time. Unless she also has a disability (you haven't said this).

    But hey, let's win this appeal, as no PPC should profit from people duped by the retailer gimmick of P&C bays, into thinking they have some right to use wider bays.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
