    OP, no one can tell you what the outcome will be, but given your short service the employer will be aware that (if they wish to) they can dismiss you with no repercussions. It really comes down to what was said, the effect it has had on the other party, and how much they value each of the parties involved.

    You need to grovel, both to the employer and to the person you were talking about. The fact that this was done in private is no defence at all.

    i wish you were in our workplace. the disabled person had a nervous breakdown over the events that happened to him/going through the grievance process and absolutely nothing bad happened to the people that caused it.

    This is exactly why talking about colleagues behind their backs is not acceptable, and is not the norm. On the information given your colleague would have had a valid claim against their employer.
  • In probation it doesn't need to be gross misconduct, they could just dismiss you for no reason.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    i agree but sadly experience it as the norm as far as talking is concerned, outside of work, about other people in general, including colleagues. texting and emailing more risky, but still happens a lot. not right at all, but does happen a lot as far as i can see.
    i would say the fact that it was done in private time is relevant to the defense, in the case i cite at work, it was all done on work time, work email and to the managers directly.

    the colleague in question is taking legal action now, thankfully. their grievance and investigation was hugely downplayed and he was fobbed off beyond belief.

    Summary as the OP has deleted their post - they have been talking about a colleague behind their back and the colleague has found out. OP wants to know if they could be dismissed.

    I had a review today,

    The concern was, that I PRIVATLY messaged another coworker (during non working time) about a couple of incidents/events that another coworker had. One was a non work related event. No harrassment or abuse or nastyness.

    Is this a cause for dismissal?
