If the content was private, how did it find its way to management?

    highly unlikely.

someone at work was caught slagging off another co-worker with a disability including ABOUT their disability (branding them a dead weight among other things) and he still has his job - a minor slap on the wrist and told to be careful about his use of email. i should also note that his emails were sent TO the line managers about his disabled colleague and his hostile opinions were based on nothing true!

the disabled employee issued a grievance but the outcome had no major repercussions on line managers who did nothing to extinguish his nasty emails (it wasn't just one time) nor the person who wrote the nasty emails.

your situation pales in comparison and i'm sure very little will happen.

Each company has different policies and a different way of dealing with things, something that can get you sacked in one place, hardly gets noticed in another.
It also depends on the OP's previous history and his relationship with his manager, and people higher up.
Unfortunately you can't use your own experience to predict what will happen in this case.

what you did is more or less what everyone does, all of the time. human nature, dare i say.

it's just unfortunate that yours quickly got back to the management but that should say more about the person you messaged than it does about you.

you can say anything you want on your private time. if its a text message - slightly more iffy as 'evidence' existed and obviously they can get rid of you for anything they like during probation - but all things considered, in my opinion, dismissal for this would be an outrageous over reaction.

how did they leave it when you were in the review? like it would be subject to further investigation or anything? they probably just mentioned it as something to mention. unless made clear you had something to worry about then i wouldn't bother worrying :) if you are worried, seek clarification from your manager about where you stand.

    No, it's really not!

OP, no one can tell you what the outcome will be, but given your short service the employer will be aware that (if they wish to) they can dismiss you with no repercussions. It really comes down to what was said, the effect it has had on the other party, and how much they value each of the parties involved.

You need to grovel, both to the employer and to the person you were talking about. The fact that this was done in private is no defence at all.

plus the person it was 'about' would need to launch an official grievance i would think and it would be a very flimsy one. like i say, it may all fall down because of you being on probation but in that event i'd say they used it as a reason because they wanted you gone anyway. i presume all else is satisfactory?
