Careful they don't accidentally on purpose misinterpret your use/position of 'since' Fergie.

In addition to my email on Mon 16 Feb 15 and the FOI request contained within it, can you please provide me the following information under the FOI Act.
How many parking charges have been issued at Northwick Park and St Marks Hospital by
APCOA Parking (UK) Ltd , since 28 Nov 14, when I brought it to your attention that this company has no authority to issue any such charges?'

    Very good probing point, Fergie.

So, the BPA have now had a response from APCOA Parking (UK) Ltd, but they can't reply to me yet, as he needs to discuss things with his Boss...
I have received a reply from APCOA but need to clarify a few points with my Head of department which I cannot do prior to next Tuesday.
I should then be in a position to come back to you from Wednesday onwards.

Perhaps they'll field Dave Smith to explain it all. :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    That was my thoughts also.

Wouldn't it be ironic, after the lengths that the DVLA and ICO have gone to, to say nothing to see here, move along, if it was the BPA that actually came out and said what we all and that there is a problem here?

I won't hold my breathe though...

Had a reply back from the ICO and the are not interested:
Thank you for your email of 20 February 2015. I understand that you are unhappy with my response. You are of course entitled to your view, and also entitled to pursue any legal avenues you feel are appropriate.

Under section 42 of the DPA the Commissioner is required to make an assessment and advise you of the outcome of that assessment, which we have done and therefore fulfilled our statutory obligation.

As I have advised previously the ICO will not be pursuing the matter of DVLA disclosing your personal data any further. A section 10 breach has been recorded against the Trust for its failure to respond within the appropriate timescale.

I just cannot understand how they think a flawed letter over-rides a legally binding contract?

Am I being dumb, am I missing something?

As if I haven't got enough !!!!!! going on, I now need to do a complaint about the ICO!!
