Having done a bit of digging I have found the following documents, which deals with Contract FOIs.

    http://ico.org.uk/for_organisations/freedom_of_information/guide/refusing_a_request#when-can-we-refuse-a-request-for-information-8 - Section 43

    http://www.justice.gov.uk/downloads/information-access-rights/foi/foi-s43-exemptions.pdf

Would it be best to appeal against the withholding of all the contract or just request the bit that I am after, ie what standing does APCOA have to bring these penalties and any subsequent court procedures.

Also, any other links from the ICO or elsewhere on the above, would be most welcome.

Wasn't it martmonk who forced NHS contracts out of some trusts? May be worth sending him a pm.

Right, after being previously shot down in flames by everyone that believes the disabled have rights above everyone else, I shall now put in another suggestion (and this was something a disabled friend of mine did).

When you are parking in a car park that has disabled spaces but none available, do something really strange and pay for the parking. And then write to the people that run the car park, complain about the lack of disabled parking spaces available attaching a picture taken on a mobile phone, asking for the parking fee back, and receiving it back a couple of weeks later with an apology.

Don't forget, people that run car parks are businesses, even the ones that run hospital car parks have to make money. It is cheaper for them to refund a parking fee than to have to fight with someone trying to have a ticket overturned.

This has worked on more than one occasion and avoids a lot of unpleasantness.

I doubt if I shall be looking at this again, I should imagine that idea will be shot down in flames too.
What is this life if, full of care, we have no time to stand and stare

As a disabled person I don't want more rights then anyone else. However I do expect if possible that reasonable adjustment is made so that I have the same rights as everyone else.

The whole thing in my opinion revolves around reasonable adjustment.

For an instance if I was on my own and had to park several hundred yards from an hospital entrance then I am not getting to my appointment. If some sort of adjustment is not made.

PS; The refund idea is a good one.

It's not about disabled people having to pay. I feel they should do! It's about treating them differently and detrimentally based on the bay they end up having to use.

I had a little trouble with Northumbria yes.

If the OP sees the posts towards the bottom of this page they'll see the FOI I sent for specific clauses.

If you look at the whatdotheyknow site you'll see other examples at other trusts including my efforts with South Tyneside.

In both Northumbria and south Tyneside examples they are using the standard 2010 NHS terms and conditions. However there are amends to it.
I would therefore construct an FOI which asks about specific clauses on authority, asks if the standard 2010 contract is being used and if so asks for details of the amends, omissions, and additions to it.

Seems to be a fair bit of discrimination against those that do not have access to a car.

No-one will take the bait, Bantex, no-one cares about your efforts to send threads off on tangents.
