    Thanks.

What puzzled me in knowing what to do was that browneyedbazzi said to cancel and unholyangel said not to cancel. Sorry I don’t know what a section 75 claim is

With regard to the card provider it is an MBNA MasterCard credit card.

Well your right to cancel doesnt end until 14 days after you have received the goods so I wouldnt be too worried about that.

The only reason I said not to cancel is that bank staff have said previously if you cancel you can no longer claim non-delivery as you've cancelled the order so obviously they're not going to deliver.

I have no personal knowledge of whether this is true or not, but I do know not cancelling isnt going to harm your position due to the reason above (that your time period for cancelling doesnt even start until the goods have been delivered).

Thank you. It is 14 days since the supplier said they posted the goods 1st class.

Is it too soon to ask for chargeback please?

Speak to your bank and see if they can send the form out in the meantime so by the time you receive it, it will be past the 15 days required.

  • Thanks.

I was going to send the MSE template letter at agrinnall's post #20
  • browneyedbazzi is correct.

Chargeback should still be available. If its been more than 15 days, you should be able to do a chargeback right now for non-delivery.

Should I wait 15 days before asking the seller for a refund?

It's just over 2 weeks now and I have been telling the supplier when Royal Mail have been continually carrying checks at the delivery office without success but I have not specifically asked for a refund.

The postman is routinely checking too and now greets me with a cheery "not today"

    Thanks for help

I thought you'd already asked the seller for a refund/replacement and they had refused until royal mail paid out?

The 15 days is in relation to non delivery chargebacks only.

I hadn't asked for a refund at that point. I had no despatch message from the supplier and they said this about having to wait for the Royal Mail claim for a refund when I sent a message a week after I ordered and told them the postman said it had not arrived at the delivery office. I did not and have not mentioned a refund. They also said that if there have been other claims relating to the same delivery address, Royal Mail may not grant compensation. I thought this remark unnecessary.

I have been asking here about when to ask for a refund, as I did not want to appear premature and unreasonable.

It will be three weeks at the beginning of next week so I will ask for a refund then.

    Thanks for help
  • I intend to send one line saying I have not received the item and wish to receive a refund.

    Is that OK?

Then if they say no or I have to wait for Royal Mail as they intimated I shall get straight on to my credit card company.

My order sent by Royal Mail did not arrive and the supplier is saying that I must wait until they receive their claim funds from Royal Mail before they will refund/replace my item. Royal Mail may take ages and the supplier says if Royal Mail refuses their claim I will get nothing.

Given what you said above, I'd forget the retailer and go via chargeback.

As I said previoiusly, cancelling with the retailer may complicate your chargeback claim for non-delivery.

  • Thanks. I did think it reasonable to ask the seller for a refund as I had not specifically done so and had only enquired when delivery of the item could be expected as it had not arrived.

So, I sent my one line saying it still had not arrived and I wished to receive a refund.

There was no reply so the next day I sent a reminder.

The reply came that they would have to speak to my local post office so I thought I was in for a long haul. (The postman and delivery office had been checking daily for me).

The seller came back in a couple of hours with the refund which has now gone through my account.

Thanks all for your help and I have learnt some things I did not know.
