Electricity board easement

Hi All,


Looking to buy a relatively new home (built mid 80's) but on the deeds there is a covenant wherby the Midlands electricity Board have access to the property whenever they need to dig up or build anything.


Furthermore no extensions or structual alterations can be made to the house without permission from the builder and in regards to extensions/conservatories the Electricity board.


The midlands electricity board no longer exists and Eon now control the electricity round these parts. Would they have the same rights or would the covenant only apply to the company as named (electricity group)


The building company seem to no longer exist in any form so Id imagine it would be possible to remove their covenant?


My final question is would this devalue the property? The surveyor hasn't revised his value based on the information given but surely the inability to be able to extend would have some imapct in price?


Im not looking to knock the price down as its already a good deal but thinking of possible resale in the future.

    Such clauses usually include the successors of the companies concerned.

    Is it obvious what the easement is for? Cables? Substation? That will clearly affect how likely it is that it will affect you/future owners and therefore the value.

    Is there a sub station nearby ? Or mains cables running underground near the house.
    We have a large main drain running across our front garden and under the drive.
    I will be careful about putting in trees in the front garden or 20/25 ton lorries on the driveway. Common Sense really.
    You need to find where the cables are and would the location cause problems if you wanted to extend

    There is a substation across the road.


    The consent is for maintenance of existing underground cables, but also gives the right to add new underground or overground wires and associated structures, if they deem them to be needed.

    I would presume the conditions still apply. You might want to clarify with the surveyor, I expect it would put some buyers off.
