Dvla problem with a SORN

Hi Everybody,

I would like to ask for some advice please regarding an issue with a SORN'd vehicle I have?

Background: My Motorhome finally broke down just over a year ago and was beyond economical repair so I decided to place a SORN on it and park it up in a friends field.
The vehicle has been sitting there since July last year and hasn't moved as it has been partially dismantled. About 2 weeks ago I got a letter from the DVLA stating in July of this year my vehicle was allegedly seen in Portsmouth over 170 miles away from where it is was seen on a public road.

This was impossible as the old girl is in non drivable state and still in the field where I parked it so I sent my reply back to the DVLA along with a letter stating that I believed my number plate had been illegally cloned and was being used on another vehicle. I asked them to provide evidence of the alleged vehicle with my number plate and sent it back as a signed for letter.

Yesterday I got a computer generated letter in which they can add the details of the alleged offence and the fine amount stating that they would offer my an out of court settlement for £0.00 and I had to pay this by 06/09/14 otherwise it would go to court unless I replied with further evidence by 05/09/14. So again I wrote a detailed letter stating my original claim that the vehicle was in a non drivable state and this time added photos of my motorhome along with a witness statement and other documentation to prove that my number plate had been cloned illegally. Again I asked for photographic eviedence of the alleged vehicle and I sent my letter recorded to ensure they get it on time.

Have I done enough to prove it wasn't my vehicle? or will they still try to take me to court? I feel I have enough evidence in the form of witness statements, photogrpahs, and other items to prove it wasn't my vehicle but as it's the DVLA you never know what they will try and do?

Any help or advice on what else I can do would be great :)
Can I claim back the cost of postage and photographs etc as it has cost me a bit ensuring they get the replies and not magically lose them in the post?

    Looks like you have done enough at this stage to show your defense. In any event, I would not worry about court as if you have to attend to defend yourself, then you will have sufficient evidence in your defense and can claim expenses and costs when they are proven wrong.

    DVLA have to check up on all cases as people will try and pull a fast one.
    NO to pasty tax We won!!!! Just shows that people power works! Don't be apathetic to your cause!

    Just accept their out of court offer, and send them £0.00 before 6/9.

    Hi I was thinking of sending them £0.00 as it would cost them to process the payment but upon reflection It also says that I admit something that I haven't done. The DVLA also could possibly turn round and slap an £80 fine on us as saying they forgot to amend the letter they sent originally.
