bank claim resulted in notice served to repay

Hope this is in the right place - apologies if its not...
I wrote to Natwest asking them to repay unfair charges with interest totalling £1703. This was in respect of a joint account (in name only as I hadn't used it for about 20 years!) with my now ex-husband. The account was just over £1500 in debit when I wrote asking for repayment of charges. They replied that it would take them 5 or 6 weeks to deal with it and we have now been served a notice under section 76(1) under the Consumer Credit Act 1974 to repay the full payment of what now amounts to £1761 by the 2nd August.
To be honest I'm not surprised that Natwest are losing patience because obviously they want the overdraft payed up and the account closed now we are divorced, but nevertheless that outstanding amount is composed of unfair charges. I feel inclined to write to the court explaining the situation and ask them to give us time to try and settle the matter regarding unfair charges.
Does this seem a sensible way forward? Helcat
