If you use an ntlworld or viginmedia email address you will probably not receive the renewal email from the gourm society because the isp filters it out as junk. You can however find it if you log into the webmail portal and it will be in the junk folder!

Weren't those amendments were made after your contract was agreed?

Does the legislation cover agreements made prior to Oct 2014?

That ninety day period ended over nine months ago.

My one started in december. But I'd suggest contacting www citizensadvice org uk Citizens Advice.

    They also mentioned;
Therefore, because the trader’s actions could be considered a criminal offence under the Consumer Protection from Unfair Trading Regulations 2008, the information you have provided will be passed to Oxfordshire County Council Trading Standards for further consideration. The case details will also be placed on a central data base that can be accessed by all the other Trading Standards throughout the UK.

Hope this helps. I would say report to watchdog and also to citizens advice.

It was in December 2013 that Gourmet Society proposed their terms, and you agreed to those terms.

Not sure what 'Consumer Protection Regulations' you are talking about, but if they didn't come into effect until October 2014 then they are not applicable to agreements made in December 2013.

Yes, that is all good stuff, and is of course the right thing to do.
However, all that is to do with ensuring the trader is trading properly and nothing to do with getting your money back.

I didn't agree to anything in December 2013. My trial started in September i think. But it is miss selling something to me i did not request in December 2014. Anyway let's see how it goes, I will post any updates.
  • I contacted their customerrelations@gourmetsociety.co.uk and received a reply saying that as a good gesture they refunded 50% of the card cost.
  • Exactly the same with me.

I am trying to get a refund as the card isn't fit for purpose for me (there is only one restaurant in my area). However, there customer service is diabolical.

I called customer services, waited 26 minutes and the call was dropped. Second call was 24 minutes before call was cut off.

I emailed them but they are refusing to budge - Money saving expert needs to expose this company before others also become 'victims'

No-one sold you anything in December 2014.

Any selling was done sometime in the latter half of 2013, so:
    a) that was before the revised legislation that you mentioned was introduced, and
    b) you are now more than 90 days beyond the selling date that you tell us that legislation allows for complaints.

I received an email from Quidco yesterday offering me a 3 month trial for £1.00 and almost signed up for it until I saw the tick box alongside the tiniest font on the page that included 'I agree to the full Terms and Conditions and that my Gourmet Society membership is an ongoing service until ceased in accordance with them'

I can imagine a lot of people will sign up for this oblivious to the fact their card will be debited 3 months down the line unless they've read the T&Cs found elsewhere on the site and phoned them to cancel in advance. It does give the impression that this is part of a marketing ploy to gain new members and revenue in a slightly underhand way.

Anyway whoever got in to trouble, please make sure you complain to watchdog and citizens advise. so that at least other people won't fall in to this trap.
