On Maternity Leave and Expecting Another Baby...

Hello
Wonder if anyone knows the answer to my question:-
I am on Maternity Leave (baby born Nov last year - currently on Additional Maternity Leave) and I am expecting another in October this year :eek: .
Will I be entitled to any more maternity pay?
How does it work with my employer? Will they just put me back on to another "turn" of Maternity Leave?

Are you planning on going back to work before you have your new baby??
I think, but dont quote me that if you do not return to work for 3 months following maternity leave then you have to pay the money back you recieved whilst on leave. If you returned to work then i cannot see you have a problem for taking further paid maternity leave as then it would be classed as 2 seperate leaves. If you did not return to work then it may be seen as an extension to your additional maternity leave (until it runs out, then a career break). As i said, i'm not 100% sure. Check with the CAB or failing that your HR department who should be able to advise you better

So again.....
You DO NOT EVER have to pay your SMP back to your employer so thats the first thing cleared up.
Your SMP in calculated on your average earning 8 weeks prior to the 15th week before the baby is due - thats roughly 17wks to 25wks.
In that time you must have an average weekly wage of £87. If you dont you do not qualify. If you do then for the first 6 weeks of your new ML you will recieve 90% of that avererage - for the remaining 33 you will I either reciev £112.75 (the stat payment) of 90% of the average calculation, which ever is the lowest.
If you do not quailfy for SMP you are still entitled to 39 weeks ML.
I hope that all makes sense and I am copying this ready to paste in the event of another black hole

if smp is calculated from 17-25 weeks what happens if your only stat sick pay for those weeks?2007 is my getting slim year

It depends on if the stat sick pay is for baby related. Where you work can make you start maternity early if they wish to do so.
I was on the sick before i had my little one as i had carpel tunnel syndrome. I was lucky yo be paid company sick pay and as baby was born 5 weeks early my SMP kicked in on the sunday after he was born. HTH:beer: Officially Debt Free Nov 2012 :beer:0 -

But do you have to pay back any employers contributions to your maternity leave? when i was on maternity leave, if i didn't return to work for 3 months following it i would have to pay back all employers contributions. However i worked for the NHS at the time and they were really generous with their maternity leave policy and some employers donbt make any contribution at all0 -
sick pay is sick pay and that will be what they base the calculations on - if you are on SSP from week 17-22 you will probably not qualify for SMP as the rate is lower that the LEL (£87).
You employer can only make you start your mat leave if your sickness is pregnancy related from 36 weeks.
SMP will never be owed back to an employer upon termination of a contract. Company Maternity Pay will follow the guidlines set out in your T&C's.
