    Hiya,

    My knowledge of this is that if they cannot supply you with a copy of the original signed agreement, they cannot enforce the debt. Thats not to say you don't owe it, just that you cannot be forced to pay it back, unless they come up with the documentation to support it.
    Who was the original debt with?

    If your credit file already has a default on it, then they can't do anything else to it to make it worse in these circumstances. I wouldn't reply by confirming you had the goods, as they've requested. I would ignore the letters and stop paying! However, if you do wish to pay, then it's on your terms and not theirs.

    Hi, i just got a letter in the post, this is what it says:


    We can confirm that we are unable to supply a copy of the consumer credit agreement at this stage. We have therefore returned the payment you have made.

    No cca = No collectable debt.

    Please confirm that you accept that goods were ordered and received and let us have your settlement proposals.

    Confirm NOTHING. You have asked Moorcroft for a cca - they have not sent you one. They are trying to force you into admitting a debt which may not exist.

    And keep asking them to provide the CCA :) THEY have to prove the debt - it's not up to you to prove you don't owe it, other way round :)
    If they can't give you a CCA then they can't prove you owe this money :)
