Parkingeye PCN ignored now notice of court HELP!

I've read numerous posts and the useful info provided by coupon-mad etc but not sure where I should start.
This Relates to parkingeye and was on ABP land. My original notice (photograph of the cars number plate) was received in early July 2013 some 4 days after the date the charge relates to. At the time my web search took me to an old forum post which was to ignore so I did. I received 2 further letters, the 2nd 'PCN reminder' 9 days after the first and the 3rd 'outstanding parking charge due' received three weeks later. The 3rd letter mentions solicitors etc. the charge was £60 if paid early or £100'

A letter was received 2 weeks ago (although dated 5/8/14) from debt recovery plus ltd referring to a recent letter from parkingeye asking for £150 (different amount and no 'recent' letter received - last was august 2013.) at this point I went back on the forum and saw the numerous advice NOT to ignore. Whilst investigating the new advice I received a 2nd letter from the debt company dated 20/8/14 - this letter is warning me of intended court action and pending to to solicitor stating additional court costs.

I guess I am now so far down the line having ignored things that I'm not sure if I can do anything now, if I can what stage should I follow?
I really appreciate any help you guys can give me here. I have until 3rd sept to appeal etc before it is sent to solicitors.

    some glaring errors in your opening post too

    ie:- there is NO WAY this was BPA LAND , it will be PRIVATE LAND owned by a landowner (one landowner that will not be the BPA)

    forum advice for england and wales changed in FEB 2013 to appeal , not ignore, as I came on here in july 2013 to fight an Excel ticket on private land, which went to popla and was won, so your july 2013 is totally untrue

    I then checked out another one in august 2013 for another relative, with PE, and appealed that one and they cancelled it

    so you IGNORE drp completely , totally, never speak or write to them at all !

    appeal it to PE using the LBCCC fightback letters , treating it as an LBCCC

    There's no 'appeal' to go through with DRP, you're in the position of pay up (but you wouldn't be here if you wanted to pay up) or wait to see what PE's next move is. DRP can't do anything in terms of court, only PE or the landowner can.

    What I must tell you is that PE are the most litigious PPC in the country and issue court papers like confetti, but that's not to say they will in your case, but they do tend to target 'ignorers'.

    Presumably you are the RK of the vehicle, PE can pursue the RK in the absence of knowledge as to who the driver was, so if you've made no contact at all with PE they won't know who the driver was. You could name the driver and hope they will issue a Notice to Driver to them, but it won't be easy to get them to do this so far down the road from original event - but there's nothing that prevents them doing so if they have the will.

Also check out the Parking Prankster's website where there is the opportunity to purchase his PE-specific book on how to handle PE court cases (not much more than the price of a cup of Costa coffee).

    I don't think the OP is at LBCCC stage at the moment, so I don't think it would help right now to go rattling PE's cage with a formal LBCCC response.

    I'd await their next move which might well be a LBCCC, but let's see the whites of their (parking) eyes first!

    frankly, half of what was written in post #1 was incorrect but the header title doesnt help as it seemed to indicate a pre-court stage, which was LBCCC for PE

    having re -read the post and ignored the falsehoods it may well be just another DRP letter, in which case ignore as I pointed out

    I wasnt sure if it was a DRP letter or an LBCCC so I covered myself on both aspects of it

    I do not believe its an MCOL, yet

    it may be a DRP letter

    I am sure the threat of an LBCCC or an MCOL is presnt in the DRP letter (they usually are)

    only the OP can decide what it actually is that they received , which if its debt collector rubbish then pointless posting it until an LBCCC or an MCOL materialises

    if in any doubt, they should treat it as an LBCCC , in which case its appeal to PE or refute the LBCCC with PE

    I am of the viewpoint that you never engage with the debt collectors on these issues, speak to the organ grinder and not the performing monkeys ;)

    Apologies for saying BPA land, I meant to Associated British Ports land but I guess where it happened at this point doesn't make much difference.

    it does if its not relevant land under POFA 2012 as they can only pursue the DRIVER if POFA 2012 does not apply
  • This is the first time I have posted on the forum and have read some very useful info and responses. I was going to ignore the accusations from Redx of ' false' information provided. I would like to confirm that I made one error about the landowner but everything else I put is a true summary of the timeline and did not contain any false information.

    This is a forum for help and advice, I don't think accusations are necessary.

    I apologise if I have caused confusion it was unintentional, but I am/was a little confused myself after reading many threads/posts and didn't think it was pointless to ask for help.

    Goldfish - please don't take umbrage. Redx has his ways of word use and we're all differently wired. Redx also has outsanding expertise for those who have Blue Badge tickets and spends hours daily helping posters here - just like Umkomaas, coupon-mad, stroma, bargepole, dee, collies carer, bod, HO87, Guys Dad and many many others.[I'll slap my own wrist for more not springing to mind on the instant:-)]

    I assure you of this, as a successful squelcher of 2 pe scam invoices earlier this year, ENTIRELY THANKS TO ALL THE HELP FROM THESE THREADS, REDX'S INCLUDED.

    As you read more, you'll see we often have to infer/auto-correct what we read from people who are sometimes frightened, panicking, angry, feeling threatened. This affects their word use where exact detail is critical.

    In a 1st post, this is often not realised.

    I have just written for another poster that skim-reading old advice equates to reading old newspaper headlines.

    The important thing is that you've found these Threads and done some reading, which is already more than many do in their first cry for HELP.

    There are several inaccuracies in #1, aside from BPA for ABP![which is one to smile about, as you'll realise with increased knowledge.] They don't matter atm as your gist is now clear.
