Naughty Zavvi

I pre-ordered a PS4 game on Zavvi back in April. The game was due to be released at the end of July and when the date approached I logged on to my Zavvi account and in the order summary it showed it hadn't been sent yet and that the price was £31.08.

When I finally received the game and checked my credit card statement, I was a bit surprised to find that I had been charged £34.98.

I contacted Zavvi and they're not playing ball. They're referring to various small print in their T&Cs, that I had used a discount code in my order which wasn't allowed (strange when it was accepted and the order shows that a £3.90 discount has been applied which is why I thought I was getting it for £31.08 and not £34.98). By not showing me the correct price, they've denied me the opportunity of cancelling the order if I'd found it cheaper elsewhere.

To be honest, the £3.90 isn't a big deal but I'm just really disgusted with this dishonest and very misleading practice. It really is the last time I will ever use Zavvi. At no point did I receive any notification about the change in pricing and they wont even explain why my order shows as £31.08. Customer Service? Hardly.

Does anyone else think this is really bad form?

    This is why i use amazon for games. They price match against other retailers and match the price in most cases. They always apply the cheaper price even if you ordered at a higher price.
    Back by no demand whatsoever.

    I love how companys do this with small amounts of money (well i guess £3.90 is a lot to some people!) so that customers never bother to follow it up.

    i agree. very bad form. as my three year old would say: naughty naughty!

    You may only use one discount code with each order. We reserve the right to reject or cancel any orders where you add more than one discount code to the basket.

    We allow you to use discount codes strictly on the terms and conditions upon which they were issued which, amongst other things, may include terms relating to your eligibility to use them and a maximum order value. Discount codes that are valid across the entire site exclude pre-orders products, electronics and any products that are valid in other multi-buy offer on site.

    That is what you are up against. Oh by the way, did you agree to adhere to these T's and C's? Because depending on your answer you may have an easier/harder time getting any money back

    But if they do choose not to accept a discount code, they should just cancel the order. Basic offer and acceptance: OP made an offer, Zavvi can either accept it or reject it and cancel the order. They can't just unilaterally decide to amend OPs offer and charge differently.

    (The section you bolded applies only to the precondition 'discount codes that are valid across the entire site' - this may or may not be relevant to OPs order, as we don't know what discount code was used).

    In the eyes o the law I don't know what is right. Theoretically (unless shown otherwise) the OP has accepted the T's and C's though and it was excluded so one could argue that OP was aware o the eligibility when placing the order. They have made an oer and there was a pricing error in relation to the T's and C's. They have been charged the "Correct" amount. It is probably unnecessarily misleading which is something to argue but otherwise the order was accepted with the details at hand


    I'm not sure what your 2nd point is about. Any discount code which is valid across the entire site encompasses any code which can be used on the site... It wouldn't matter what code OP used because it simply has to work in one respect to be eligible. As OP has mentioned being told to check the T's and C's I suspect it was a normal discount code which met the criteria

    In which case the site should have refused to accept the discount code for a pre-order. Zavvi can't have it both ways.

    It's not just misleading, it's outright wrong. OP has never made an offer for the 'correct' amount, Zavvi can't just decide they have. The only options open to Zavvi are to accept or reject OPs original offer, not to modify it.

    A "10% off at Zavvi" discount code would be one that was valid across the whole site.

    An "Order this specific game and get free shipping" code is only valid on a single item, not across the whole site.

    But as bod1467 says, if it wasn't valid they shouldn't have accepted it.
