  • How long have you owned the car?

    Did you take it back to the selling garage when you realised the breaks were poor?

    Did you highlight your concerns re the MOT?

    What did DVSA say?

    Did you take it back to the selling garage when you realised the breaks were poor?
    No, only today the noise started

    Did you highlight your concerns re the MOT?
    Not yet

    What did DVSA say?
    Not yet contacted

    My main concern is that the car never had a full main dealer service or a proper MOT. The car was advertised to have a full main dealer history, which doesn't appear to be the case due to falsified information by the main dealer.

    ^^ They'll say anything to get a sale.

    Never trust an MOT that was done my the people selling the car (or mates of).
    Never trust a main dealer to service your car properly, most service depts are under pressure to meet unrealistic targets.

    What's the car?

    Many run of the mill cars, you can get a pair of discs and a full set of pads for about £100 and then you can enjoy the next 20,000+ miles without having to worry about it.

    Cars can pass MOT's with heavily worn but still functional brakes, a dealer can sell a car with heavily worn but still functional brakes. Brakes wear. It's what they do. It's how they work.

    Kwik fit will happily sell you a full set of new brakes (and a couple of shock absorbers if they're easy to get to, and some tyres and a new exhaust back box, and any other part of your car that they can change inside of 5 minutes) but it won't be the best vaule you can get and there is no such thing as a 'free' lunch. Their opinion or brake wear would not be acceptable as 'proof' that brakes are worn, and as above brakes are ALWAYS worn, it's just case of how much.

    Indeed. The MOT does not test for brake wear. It only tests for function. If the tester can easily see the pads and discs without removing the wheel, then he may advise for heavy wear. But he is not allowed to remove the wheel as part of the test.

    A service? Now that's another matter...

    OP - go back and tell us about the actual _problem_.

    If this is the case then you need to stop driving the car at once and inform DVSA.

    Stop huffing and puffing, and take the car back, complaining of noisy brakes.

    Be nice and they will likely renew the brakes for you.

    You will never prove anything with the dealer service record., although again, if you are nice, they can print out a history for you of what was done, I have one for my car that details everything above the regular services e.g. rear wiper blade replaced.

    (Remember you catch more flies with honey than vinegar, although as dealers know, you initially attract them with BS.)
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
