Seller lied on form

    Not bad, just very foolish ..... unless (of course) it has a colour bleed-off feature :p

    Can you imagine life if the shade isn't quite right?

    We received the Seller forms from the Solicitor today, they seller has put a big fat "NO" to any electrical work carried out since 2005...


    Anyhow, whilst I was in the attic having a peek around (vacant property :)) I noticed some DIY standard electrical work. Unsure what colour the wiring was, however it was in a electrical choc-block with tape over it.

    If this wiring is Blue/Brown, then its post Part P introduction (Jan 2005) and the seller has lied, or the seller before them has lied..


    The question... Because of this, if it was to be installed after Part P intro, what can I do about it? How would you enforce the repair...


    All hypothetical right now, but its nice to know... If I was the seller, I would have answers Not Unknown to most of the questions but they have gone with No..

    Blue brown wiring has been the standard for a long time, probably 20 years!

    Also, the SPIF form is vague about electrical work. I'd, for example, expect people to detail major works like a consumer unit replacement, or any work that genuinely requires part P like electrical installations bathrooms/kitchens. But I wouldn't expect people to list minor DIY alterations like putting new lights the lounge, or adding a spur where allowed.

    You don't 'enforce repairs', you offer what the house is worth to you.

    For example, if you want the electrics botch fixed and you think it will cost £500, you might offer £500 less than you would have otherwise.

    And don't forget the fish.

    Well there is 2 major things which we did not know about when the offer was made.


    The question was about enforcement of the sellers form, and what it actually means with regards to enforcing repairs. Obviously we would not "spot these errors" until we had fully moved into the house etc..

    I highly suspect there will be some form of DIY electrics, DIY shops still sell the stuff and people sometimes don't know the rules as its not well published when stood in from of the Electrical Stuff in a DIY shop.

    Electrical Wise - Were not really too fused, as i am a former electrician..


    However the warped flat roof, and the garage roof beam snapped We Are! (we could not view the garage, only peer through the window when viewing)

  • You're talking as if buying a house is like buying a fridge, from a retailer, where you have all sorts of consumer protection and the retailer is expected to be a professional, with a duty of care to the consumer.

    You are buying a house from a domestic seller under the time honoured rules of caveat emptor - "buyer beware". The seller only has to offer information in good faith. They've actually admitted they didn't get planning permission and your solicitor told you this, so it's not like they've been secretive.

    If you chose not to have a survey done, you've missed your chance to renegotiate the price. You've also missed a chance to walk away if the condition isn't what you expect, for that price.

    I find lentil soup is always improved with the addition of celery salt. :rotfl:
