Tenant Deposit

Wonder if anyone has any advice for me. We have recently took our properties back from a LA. All our tenants have been fine, paying the rent to ourselves and transfering the deposit across to ourselves (we are in scotland). Even the local council have been on the ball regarding the HB. But we have one tenant who has been a pain in the perverbial. They are paid hb direct to themselves. It took us just under 2 weeks after he told us he had spent some of his rent money, in dribs and drabs to get the rent. We have been waiting about 3 weeks for the deposit to which we still haven't got. Their AST runs out in August so we are now under the 2 months for a S21. Everytime we try to speak to them the guy is totally cocky and he is really wierd. It is always in a couple of days. If it comes to it and we have had enough of them, what is the best way of getting rid of them? Do we wait till the AST runs out in August and then use a S21 or any other suggestions? Oh and we are in Scotland so I don't even know if we can use S21 up here or what is there alternative? Any help would be great.

    To be honest I would think you have had enough of them already. I would get them out ASAP.

    If I may be brutally frank with you, might I suggest that the procedure to evict a tenant ought to be familiar to someone who lets out a number of properties. I would have expected you to know this stuff --- if you don't, getting rid of the LA was a really bad idea. It would worry me as a tenant if I knew that my LL wasn't clued up about the relevant laws.

    Suggest that even it tenant pays up you might like to think about finding out this kind of thing. Dread to think what would happen to you if all your tenants suddenly stopped paying the rent!

    Just back from a short break. Believe me the LA was worse, They had 2 tenants that didn't pay rent. They didn't even bother to try to evict them. One went 3 months later through the night. The other just told them they were leaving. The L A was taking viewings to properties that had not been cleaned after the last tenant had left. One flat had broken eggs lying everywere and they didn't even let us know. If was only an off chance to visit the property that we noticed the mess. They didn't do any 3 monthly visits. I even asked them for advice regarding the awkward tenant they didn't have a clue. I would also point out that I had been checking regarding law over eviction but could only find forums for English law not Scottish. We have been lucky regarding tenants and now that I have come across an arrogant tenant I am trying to find out how to deal with it and once I have done it once I am sure I will get the hang of it.

    Well done for ditching the LA - I am a tenant and I have found that LA make things much worse for us. It's so much easier dealing with the LL directly, unfortunately in our area of London, there doesn't seem to be too many private LL.

    Thanks Littlesaint. Seem to get a bit of stick from people for ditching the LA. But we found we were dealing with most of the problems ourself. The only thing the LA were doing was collecting rent and then taking off their fee. The final straw was when they moved town and didn't make any arrangements to collect rent from the people who couldn't get to their new office. We had one tenant come into us in a panic (we have shops in our area selling domestic appliances and furniture) saying that she hadn't paid rent in 2 months as they hadn't sent her any form of payment book or mandate and she had no way of getting to their office as she worked in a town in the opposite direction.
