Yep why not - but you will win at POPLA stage anyway if you use/adapt/tweak to suit, a PE version of a 'POPLA template appeal' (in post #3 of the newbies thread).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

dee- just a tiny note to insert 'no' here, #8:

' there was no initial loss, ', just in case.

tff - #10. 'I have received your speculative parking 'invoice' impersonating... ' is often used. I like it:-)and DO put 'invoice' in quotation marks: it's not a real invoice and this shows you know your stuff.

  • I've had two PCN reminders through the post today even though i sent the appeal via online form on 27th and 28th respectively. They dont email confirmation that they have received the form, but i got screen shots of the confirmation page on their website, Is this the correct procedure thus far?

Yes it is. Apologies for the missing "no" by the way.
Letter probably prepared before appeal arrived.
They have 35 days to answer appeal.

Oh dear. Hopefully the assessor who has read many of these appeals will read what he expects to see rather than what is actually there.

And actually if you just sent the template appeal, the words I was referring to were not in it. But at POPLA you will say as per many of the examples that there was NO initial loss.

  • Hi Folks, I have today received a reply to my appeal for one of the PCN's and it has been unsuccessful, I presume i have the standard letter from them, it mentions a court case ParkingEye v Barry Beavis and Martin Wardley presided over by HHJ Moloney who is the highest judge to have heard a case for private parking.

Is this all pretty standard? Do I just continue with the appeal to POPLA now? Is it all still viable as there are a list of FAQ's which seem to cover all there bases, but i again presume this is a ploy to get you to cough up!

Any advice would be gratefully received ;)

Yes. Straight to post 3 of newbie thread and link to how to win at POPLA.
Chose the most appropriate PE appeal, which will cover the Beavis case as part of it and apply to your situation.
