Sole Traders

The BPA Ltd. permits sole traders to be members but apparently is completely unaware of the legalities surrounding sole traders, basically that they are required by law to identify themselves by their real name in all their business dealings e.g. A. Crook t/a Scamming Parking Scum.

So to help out the BPA Ltd. with its omission here's a list of all the current AOS members who appear to be sole traders. I've got home addresses for most of them but MSE will have a hissy fit if I publish them here:

    I don't think sole traders should have any access to the dvla database, there appears to be 1 or 2 in the ipc as well
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Sole trader invoices

    If you’re a sole trader, the invoice must also include:
    • your name and any business name being used
    • an address where any legal documents can be delivered to you if you are using a business name

    Seems to be enforced by trading standards, also:

    The legislation which covers this is the
    Companies Act 2006. Anyone found guilty of
    breaching the disclosure requirements can
    be fined up to £1000 and pay a daily fee up
    to £100 until the breach ends. Also, if you
    were in breach of the Act at the time you
    made a contract, and you take court action to
    enforce the contract, the proceedings can be
    dismissed.

    could be worth adding to appeals regarding sole traders.

    Absolutely. Not come across a parking sole trader yet who makes the legally-required declarations on their signage or notices. They haven't a leg to stand on.

    Guessing that for the most part their landowner contracts are worthless too.

  • For this particular class of oik, could a POPLA appeal be based on the fact that there is no contract, because the legal entity with which an alleged contract is being made has not been declared. It's impossible to make a contract with an unidentifiable, nebulous name which doesn't legally exist.

    This is similar to why not so smart got banned last time.
    Both bpa and dvla claimed it was ok.

    A copy of the letter from companies house showing it was a criminal offence kicked them into action.

    Yes of course. You could even point out to PoPLA that any evidence the operator submits is worthless and must be disregarded if it doesn't declare the sole trader's true identity.
