Missing Cleared cheque

Just spoken to the bank, again, what a total waste of time, they said there is nothing that they can do, it is a dispute between me and the company I wrote the cheque to. Was told yesterday that a fraud case could be opened to see who cashed the cheque and where, told today that cannot happen. Doesn't help me get my money back.:mad:0

Stop speaking to them and start complaining seriously with the intent to take matters to FOS ultimately.
If they can supply you with the proof that the cheque was cashed by the garage, you can sue the garage via the SCC.0 -
Have been in touch with the consumer credit line and they have told me to send a letter recorded delivery asking for proof that the cheque has been cashed. I have emailed them with this request with a copy of my bank statement showing the transaction of the cheque being cashed/cleared and will also send a letter stating the same. If not with have to go the SCC route.0

As long as you were clear enough in your phone call, this is your banks problem.
If they told you to make a CHAPS payment (and did so on your behalf, rather than you doing it separately) and based on your first post, they should have placed a stop on the cheque. This would have ensured it was not paid when it was presented for the third time. It's also their fault for using 'please represent' as a return reason in the first place.
Your bank can't control when a cheque is presented, they can only control whether it is paid or not.
(And it wouldn't say "payment countermanded by order of drawer" as that's not one of the reasons. Most likely is simply 'Payment stopped' although 'no mandate' is available there was a mandate that has been stopped...)0
