Surely your reason for wanting to terminate the contract even if they honour the agreed price, is simply because you have already taken out a new contract elsewhere:

It seems a little unfair that the OP should have to pay anything.
You may use a gym for 1 month during a notice period, but there's no way a parent would want a child to go to a nursery for just one month - it's too unsettling, and the nursery should understand this.
If the don't refund in full, it just goes to show what a thoughtless nursery they are, putting money before the kids.
OP, I'd write to them explaining their unfair T&C, and insisting on a full refund. I'd go as far as sending them a letter before action if they don't cough up.

Being honest I cant see the nursery turning round and saying "sure, we'll give it to you at the original price for the original duration". And thats really the only basis I can think of that they'd be able to tie OP in to continue the contract as agreed.You keep using that word. I've had a look but it doesn't look like you can post on their page, and I don't know any other parents to talk it over with.
It would appear that the increases are different for different children (how many days they attend/how much of the place is funded etc.) So not everyone has had such a big hike, I'm just one of the lucky ones!
I may be off track here, but by the fact the nursery has officially given notice of the price increase am I right in saying that they can't back track on that to keep people in contract?
I think I will demand termination of the contract with a full refund, with the exerts of the UTCCRs included.
I may also without prejudice make an offer based on one months notice (starting now) under the old prices, in an attempt to resolve it amicably.0 -
While you're at it, dispute any claim that they ever gave you notice of the price increase. Their claim that they sent a text message seems pretty poor. They should have sent it by a more durable means.If it sticks, force it.
If it breaks, well it wasn't working right anyway.0
