Hello Colleague Justice Seekers,

Like thousands of you I am attempting to seek justice.

My process began last September when I wrote to Barclays Bank informing of my intention to reclaim their Penalty Charges. With all the details dating back in my case 5 years, I asked them politely to repay such charges and cited relevant cases on the situation as given on this and other sites of the legal precedents. I also provided them with all informtion of when such penalty fees were added to the account of my wife and me. This amounted to nearly £2000, a the time. Now the charges have accrued to more than £2400, by mid June this 2007; in April this year they offered £1440, as a gesture! I politiely wrote back stating that they still owe at that time £600 in addition and requested this amount or I would consider litigation. The amounts as indicated accrued and on the 27th June I went to Plymouth County Court placing an action against the Bank for the amount as stated.

I have just heard today that they intend defending all the claim and have 28 days from 2nd July to make a defence.

Has any one been in this situation and what have you done or is the best legal defence I can give? Also I am a little concerned that I intended this to be registered for the Small Claims Court. And it now appears it is going through the County Court process. My concern are fees if I lose? Or is this the case or not the case? I do not want to give up in this case as I have unfortunately been with this bank almost 18 years which really means nothing to them.

Is there any real legal advice anyone can give through reality or legal precedent?
