    If you are a full-time student with no income then you cannot pay it. So tell them that.

    If you can avoid acknowledging the debt for the next six years (paying anything and/or putting anything in writing agreeing that you owe the money) then it effectively drops off the record. You would have plenty of time after that for house-buying and so forth.

    The above is appalling advice, and obviously wrong, as you can of course be taken to court for the debt, and quite possibly will be.

    Please, don't act on it.

    You said your Mum sold the car for a lot less than it was worth. This was probably because the person who bought it knew there was a loan secured against it and expected the finance company to catch up with them and ask for it to be paid.

    They probably can't believe their luck that that hasn't happened.

  • yeah i think my mum gets angry cause deep down she feels guilty. i went to her for help because she i used to take her advice, she said ignore my court date.. so stupidly i did. she said they were just trying to frighten me. and it did. but i didn't go and the next thing i knew they wanted to take me to court for not going to court.. it turned into a criminal offence! i was so frightened i called up in tears and my mum saw how upset i was so they agreed to take £30 per month. a few months down the line mum stopped paying it. even though she can afford it.

    because i'm a student and everything, how would i go about something like an ivf or bankruptcy or something? i still have my own bills to pay and even with uni and a job i couldn't raise enough to pay it off anytime soon.
    i'm going to ask my sister to get a loan to clear the balance. my sister deals with my mums money.. sorts her bills out, pays things online, that sort of thing so she would get it back no problem. i hope she agrees.

    They cannot chase the new owner for the debt. If the debt was secured against the vehicle, which would be the norm for dealer arranged finance, then they could chase the recovery of the vehicle. If the debt wasnt secured onto the vehicle then its basically a personal loan and they'd have no power over either the new owners nor the vehicle itself.

    If the new owner can prove they didn't know or suspect it had finance (otherwise known as being an "innocent purchaser") then the finance company can't recover the vehicle from them and they'd have to sue the seller for the money instead.
