As said, there is a defence to not naming the driver....A person shall not be guilty of an offence by virtue of paragraph (a) of subsection (2) above if he shows that he did not know and could not with reasonable diligence have ascertained who the driver of the vehicle was.
A court would expect proof of the efforts you made to identify the driver, not an easy task. "Reasonable diligence" is open to interpretation.
BTW: What was the alleged speed? You could be offered a SAC.Always try to be at least half the person your dog thinks you are!0 -

Depending how far over 30 and the area, it may only be a speed awareness course (or similar) which carries a cost but no points.0

Pragmatism: Name the one of you who has least to lose on insurance (eg. is one of you a company car driver), and pay half each.0
