MET parking services chArge notice appeal

Hi,
I'm new. I got a parking notice through the post from mcdonalds, which I was surprised at as I have been parking there for 10 years and not noticed any restrictions. On complaining to the manager, I was told the signs were only put up recently.
I put an informal appealing into MET, which was rejected. Unfortunately I admitted I was there, but told them that I was unaware that their parking terms had changed. They sent mope a picture of their sign (I will try to attach) which is dated the day AFTER I was there. Also, the "invoice" has no mention of VAT, but I am unaware of whether MET has a high enough turnover to be registered for VAT.
I have read through the appeal letter template, and plan to argue the "no contract" and punitive charge route.

just send the template letter "as is" in future , no cherry picking
forget about what happened on the day or vat
if you do spot any flaws, leave them for your popla appeal
if you have a popla code, draft a popla appeal in notepad using all arguments, again , no cherry picking0 -
I am at the popla appeal stage, will draft it now. Should I post it here for comments?0

you can if you wish, but omit any personal info like reg number, popla number , pcn number etc0

I was issued with a parking ticket on 8th August 2014 for an incident which occurred on 3rd August. I am appealing the validity of this charge on the following grounds:
I am not liable for the parking charge, as I didn't enter into the alleged contract to pay such a charge.
There was no signage
The car park in question has no clear signage to explain what the new relevant parking restrictions are. I have been parking at this restaurant for ten years and have not seen any signage. The operator has sent me a photograph of the signage showing the new contractual terms dated the 4th August 2014, the day after I was parked there. This means no contract can be formed with the landowner and all tickets are issued illegally. Please see attached evidence, the photograph the operator sent me.
[should the assessor find that there was a contract in place] The charge is disproportionate and not a genuine pre-estimate of loss
The amount charged is not based upon any genuine pre-estimate of loss to the company or the landowner.
According to the Unfair Consumer Contract Regulations, parking charges on private land must not exceed the cost to the landowner during the period the motorist is parked there. In my case, the £100 charge being asked for far exceeds the cost to the landowner of being free for the first 90 minutes.0 -
I think you've used the MSE Article template letter by MSE Marcel? We don't use that one - winning POPLA appeals are found linked in the Newbies top sticky thread on this live forum, not in any article the MSE team have written. We know what we are doing! Post #3 of the top sticky, click on the link 'How to win at POPLA' which finds you a wining POPLA appeal to copy and adapt. I'm sure I put a MET version there.PRIVATE 'PCN'? Hi coupon mad,
Thanks for the new letter link. My letter from met has a close up of my number plate on my exit photo. IT is dark and enhanced, but readable. Should I adjust the letter accordingly.
Also, I'm sure the signs weren't up yet, I was there on a Sunday and the photos of the signs are on the Monday. Should I add this in, or leave the letter verbatim?0 -
the pictures are anpr pictures, fully explained in one of parking pranksters blogs0
