Neighbour has access through our alleyway - is now keeping his bins there

We have an alleyway behind our back garden that is on our deeds and our next door neighbour has "right of access" to get to his back garden through
For 6 years, no problem whatsoever
The last few weeks, for whatever reason, he's started storing his bins in the alleyway, right next to our back gate. Regardless of the smell and other annoyances, I want him to start putting his bins back in his garden
I'm going round to speak to him but, to be prepared for him to be a bolshy, go f*** yourself kinda guy, what sort of stuff covers me? If he refuses, do I speak to the council or do I have to go down a legal route? It would be nice to be armed with the next step available to me for when I go round
Presumably, he cannot keep his bins etc on OUR alleyway - his right of access does not cover him for that right?

Are you sure it's *your* alleyway? It would seem odd that you own the alleyway as it goes beyond your gate as far as his. If you owned the bit as far as your gate, it would seem plausible he owns the following bit as far as his gate.
I have a similar layout, where mine is the furthest of three houses that share the alleyway, and the whole of our alleyway is shared between the three properties, no one house owns any particular part, but I'm obviously the only on to use the end part.
The only time I put my bins in the alleyway is if I go away - I leave them outside my locked back gate, a friend take them round the front for collection and puts the empties by my back gate. Is it possible your neighbour is away?
Even if the alleyway is entirely yours, it might sound more polite to say when you see your neighbour, that as it's a shared space, you'd prefer he didn't use it to store his bins, would it be ok for him to move them? The less confrontational the better, no point falling out over it.0 -
Same situation next door. They own the alleyway between our two houses but I have a right of access through it to my back garden. It is not that unusual as I owned an end terrace years ago where the freehold to the alley was mine but the 8 houses in the terrace had a right of access. The idea is to keep the alley clear so people can use it for deliveries, bin collection etc. It's very handy when I have new kitchen appliances delivered as the delivery men don't have to go through my very narrow hallway and then negotiate the awkward door in the dining room to get to the kitchen.

Have you got family legal protection along with your home insurance, great for legal advice on issues like this.
However, go talk to the guy, it always is the best thing. He may not even know there is an issue or it may even be temporary for some reason.I like the thanks button, but ,please, an I agree button.
