CMS Parking Ticket on Company Car Park

Hi all,

I have read the sticky notes and a few of threads, most of these are referring to the commercial/retail parking.

I was parking in our company car park, which a valid pass needs to be displayed, I had a temporary one which had slipped from the dashboard and obviously the warden didn't see it therefore I was issued with a ticket on my window screen.

I have been in touch with the building manager, he has told me there is nothing they can do I have to get in touch with CMS directly and appeal.

I think I have very strong ground to appeal, as our company is short in passes so we have been issues temporary paper ones while the building manager sorts some new ones out. So what do you recommend I do? shall I wait or just appeal now? also all the advice on existing thread do they apply to Private Company Car Parks managed by these security companies?

I would appreciate any advice thank you very much in advance.

The ticket was issued in England (also live in England, don't know if that makes any difference). As mentioned before the Building Manager is owner of the Land and he isn't going to cancel it - he has told me to get in touch with CMS directly.

I am the registered keeper of the car (not a company or hire vehicle).

I am over the age 18.

I received the ticket on the Wednesday 6th Aug, they have also taken photos as evidence.

Ok the first thing we will need to see the signs from the car park if you can host them to tinypic.com and put here with missing links.

CMS are members of the IPC so you will need to plan you attack carefully.

Still wait for the NTK but in the meanwhile read recent threads about IPC on here to get a flavour of the different styles of appeals that are being out in.

If you can post a redacted image of the windscreen PCN as well as the NTK when it arrives that will be good too.

And to be honest I don't like your building manager. This is a rotten thing to do to his tenants. It sounds to me like he is in for a cut of the proceeds! I would love to see his contract with PCM!

The fact that he is sorting out the permits and they are short, yet at the same time he has the contract with PCM to manage the car park sounds very dodgy and suss to me.

If you search this forum (using the heading next to 'forum tools' above the top sticky thread) for one keyword CMS you will find LOTS of threads about them and cases in company and residential car parks. Wait for the first letter then send the template appeal.

Come back when you've got the rejection letter in about 2 months time...when you are ready to do the IAS appeal.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks Dee140157, I will take some photos when im back in the office on Monday.

In the defense of the Building Manager, we have had 6months to sort out the passes... However they are making a killing from our company, and most people have just paid the fine. Shocking I know.

Thanks for you both for your advice I will just wait for the NTK, what are the chances that I dont win the appeal and have to stump more than £60?

The chances you won't win the first appeal, high
The chances you won't win the second one, not sure as it is IPC. This requires a lot more work at the moment to get it right. It will depend very much on what the signs say. This is crucial for appeal, whether they are old or new signs.

Of course if you do win, you could then show all your work mates how to win! Just how popular would you be then.

Showing us what the signs say (a photo or two please, not your typed version of what you think it 'more or less' said) is key to whether you are likely to win at IAS stage.

    correct

so add them to tinypic or photobucket and then add a broken link using hxxp not http to link from here, a forum member will then fix the links for your hosting site so we can see them
  • Thanks Redx

I have uploaded a picture of the CMS notice within the car park - on tinypics.

    hxxp://i62.tinypic.com/in7s75.jpg

Letme know if the link doesn't work, I have tried it and it seems to work for me.

Don'tknow if it would make any difference, the car park was recently developed (Jan2014) so everything is new and very well kept.
