Yep that's fine - I would just add a number 1 to the first point of appeal as it's missing, and would put this as the final paragraph within that point #1 as it leads better to point #2:

Excel cannot include their operational tax-deductible business running costs - for example, costs of signage, staffing and dealing later with the appeals, or hefty write-off costs. This would not represent a loss resulting from a breach of the alleged parking contract and in any case I believe Excel are likely to be paid by their client - so any such payment income must be balanced within the breakdown Excel supply and must be shown in the contract, which leads me to my next appeal point.

Then be ready to read Excel's rubbish 'evidence and GPEOL calculation' when they email it to you in a few weeks. You will have a window of few days before POPLA make their decision, during which you can email a follow up final word pointing out where Excel haven't rebutted your appeal (e.g. if they include the man hours of staff dealing with appeals clearly that's not a GPEOL because only 2% go to POPLA (so most PCNs never incur those costs). You can find a rebuttal ready to email to POPLA after you see Excel's version, if you search this forum for 'Excel GPEOL rebuttal'.

  • Thanks again, I already have that in point #1 so youre saying I should move it to the end of point #1?

Ive put it at the end of point #1 so if its ok I'll send it in, sorry just one question, there are various 'grounds to appeal' on the popla site, which one do I submit this in?

Tick 3 of the 4 (obviously not stolen, unless it was). Standard forum advice.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes of course. Sorry if that wasn't clear, it obviously leads to the next point because it says so, therefore it reads better placed at the end of point #1.

    Well here I am again...

Had the Excel evedence pack for popla and its so full of tripe, their photos of the site are obviously old ones as the signs look nothing like the ones they sent popla. They make no mention of it being a P&D car park and neither do their pictures of the signs.

Coupon mad said about sending a rebuttal, Ive had a look around this site but cant find anything, can someone point me in the right direction please?

'Excel GPEOL rebuttal' or 'VCS GPEOL rebuttal' as a search term, will find it (written in May or June I think).
