used car a complete wreck
Hi everyone,
I really would like peoples expertise in a matter I am currently dealing with.
Basically I bought a 2nd hand car from a dealership the end of June and it was described as the perfect car, reliable etc. There was no mention of any any problems whatsoever but within a couple of weeks it had a bad oil leak. I had this repaired and the person who repaired it said the oil filter was badly corroded.
A few days later I took it for an MOT and it failed badly. Apparently there is excessive corrosion under the car and the person who done the test said as he was touching it his hand was going straight through it. His words were "the underneath of the car was rotten and far too dangerous to pass".
There were other problems also ie the drop link had snapped, a tyre was not fitted properly, the tread on a tyre was not legal and the break pipe was excessively corroded.
I contacted the dealership who sold me the car and he is now trying to say the car was sold to me as a part exchange trade clearance and was "sold as seen", which this was not mentioned in the advert for the car.
Rather than offer me a refund he has gave me some rather absurd advice saying if I scrap the car I can make more money than what the car is worth or I can go and basically pay for all these repairs myself which I darent even think about how much all of this would cost.
I have contacted Trading Standards but I havnt been told whether I can definately do something about as I have to wait 14 days to see if the dealer will give me a refund (which hes already pointed out he wont) but I believe I have a very strong case to take this matter to court so could I please have some advice on whether people think I am right in taking action.

How much did you pay for the car? Did you get a warranty with it? and have you anything in writing?0

Take a deep breath and think carefully. I don't know how much you paid for this shed, but it may be that the best course of action is to do nothing. Get a scrappy to take it away. Banging your head on the wall won't be of assistance. Trading standards won't be of a lot of help with a hole in the wall dealer.0

regardless of how much was paid or if the car had a warranty, if this guy is a dealer he has to still abide by soga! a dealer cannot sell a car as sold as seen. if he had said the car was spares and repairs only and could only be taken away by trailer then fine - but if he has sold it as ok and allowed it to be driven then the OP has rights!0

I had a dealer offer to deliver a car to me. Thought odd at the time but handy.
Receipt already made out as spares or repairs and delivered to the customer. You know you have bough a shed when that happens.
But it was only a few hundred £ and i had all the tools and knowledge. Surprisingly it only required bodywork repairs to the wings and a very small repair to the boot floor for the MOT.Censorship Reigns Supreme in Troll City...0 -
Hmm. Why did you buy a car that was supposedly 'perfect' and 'reliable' that only had a few days MOT left on it? Why didn't you ask the dealer to MOT it prior to sale?
Despite that. it's clear that the vehicle was not legally roadworthy when he sold it to you, (due to the bald tyre and corrosion alone) so that is an offence in itself.
Reject the vehicle in writing on this basis and ask for a full refund: tell him that you will involve TS if he does not comply. Then if necessary go via the small claims route.
That's much easier than trying to prove the description he gave you was false.No free lunch, and no free laptop

NEVER, NEVER, NEVER buy a car from a dealer who claims the car is fit for the road just because it has a fresh 12 month MoT !!!!0
