After getting a parking ticket and ignoring letters regarding this for 2 years, I finally got a court summons which I appealed based on information I gathered from this forum. However, P@rkingEye have now responded via the right to defence and sent me a 50 page document. I now understand that I have to go to the small claims court and to be honest, I don't have the time or money to do that. I therefore understand the best process now is to suggest settling out of court. Please can someone talk me through the best way to do this and in particular how to then potentially get the charge down? I note that on all the documentation I received yesterday, it is not even clear now how much they are claiming against me, although the original charge was £85. TIA!

So, you appealed using information here and now PE have challenged you, you want to cave in? You do realise that they will probably not accept an out of court settlement?

Now, I'm no expert, although I have been reading these forums (fora?) for a while, but I would suggest that you fight this, otherwise PE will get a CCJ against you, that will cost more than the £85 you quote here.

I could be wrong about them, but other, more experienced members on here will tell you more.

Date of alleged parking event? If pre-October 2012, ignore, or rather, take delight in pointing out the error of their ways and defining 'harassment' for them.

Carefully tell us what you HAVE received.

PE can't send you a Court Summons. PE is not a Court.

You don't have to go to a Small Claims Court.

You have been panicked into mis-reading and swallowing their garbage.

Set out dates of letters, your recall of any p/w received and we'll advise you from there. PE are just another scumpany on the money-making merry-go-round.

Sorry - I should have been more specific as it was January 2013, so not sure where that leaves me.

I appreciate your comment, but I guess I am confused as the reason I never paid in the first place was because people on this forum were advising at that time not to pay and just ignore the letters. Now as a result of this, I'm having to continue to follow what people are saying on here and as each case is different, it isn't easy to work out which way to turn as part of your defence and i'm certainly not good enough to defend myself in court. Trust me, I don't want to give up, but after I appealed and they now had their reply to defence I am unsure what else I can do. Last thing I want to have to do is go to Northampton to defend myself in the small claims court.

you dont have to go to northampton, you get it allocated to a local court

plus, if its pre POFA 2012 then the RK isnt liable, only the driver who you dont have to name , but if its jan 2013 then thats after POFA 2012

I suggest you dont make any more assumptions at this time

We'll drop that now. You are not alone in this error.

Gently I say you did not follow the advice on here at the time, like many who do not read carefully. You'd be advised to lose the tone of blaming forum advice, rather than using time sensibly now to combat PE.

You must start an orderly file.

redx - I'm concerned that mention of Northampton means it has already been filed as a CCJ.

Sorry - to be clear i'm not blaming the forum at all and clearly sounds like I was probably looking at dated posts at the time. As all the information is at home, I will give the full details of what's happened so far either later today or tomorrow. Should i start a new thread when I do this or will people still look if I reply to this one? TIA!

I believe he has an active MCOL from the bulk handling centre in Northampton which he needs to acknowledge etc, same as every other PE victim

this doesnt mean he has to go to Northampton, that is an uninformed assumption by him

he allocates his local court on the N180 I believe

and read post #5 of the NEWBIES sticky thread too

and jan 2013 is 18 months ago, not 2 years ago, which is important as the law changed in oct 2012 with POFA 2012
