credit card claim back. what are vis card scheme regulations?

looking to try and find the visa card scheme regulations regarding charge back / disputes

yes, they turnd down my claim under the visa card regulations. but didnt tell me about wont show me them now0

The Visa Europe Operating Regulations are not freely available online. The Visa International Operating Regulations are though if you just do a quick search on Google.
Be warned though - it is a hefty document which can be pretty hard to make sense of.

paid for repair on car to be done at garage in may
not done correctly and they refused to rectify issues
so contacted cred card company that i paid with
i obtained 3 seperate garage statements , saying car still faulty head gasket (thats what i paid him to fix)
cc happy with those and all docs i sent in, they said i had a strong case.
i then had to scrap the car due to money cost , tax, and insurance , as we had another car with the insurance due to be switched over.
(i asked cred card company if it was ok to sell car , as case was ongoing), they said it was as i had already got enough evidence supporting my claim
then in august i get a letter saying the other person has responded to my claim and of course disputes everything.
so i had to reply , stating again what happened, and that i have had to scrap the car, then they tell me because i have scraped the car , i am no longer able to claim under visa card regulation because the car is not avabible for return.
the garage has never been willing to accept the car back for a repair, i asked before going to cc, and they have never requested it back to look at or fix.
i was neve told not to sell/ scrap the car and how long am i supposed to keep a car i can not use, and tax and have it insured. what was the time limit i had to make it avaible for return for.0 -
The Visa regs do state the car has to be returned and proof that the merchant has the thing back submitted for the chargeback. The card issuer should have told you that at the time of the claim. Effectively you can not claim a refund and have the item. I would reiterate to HSBC that you have already tried to resolve this issue with the garage. It would be helpful if you have evidence of any communication and where they refuse to do anything - i.e. copies of any letters, emails or details of phone calls. I would also state to HSBC that therefore you have fulfilled your obligations under a Reason Code 53 Chargeback (as per the Visa Operating Regulations). Yes sorry, i now see it's a service issue. The garage says they did the work and the o/p says they didn't/not happy with the quality of it. Now the car has been disposed of there is no further evidence to produce other than the existing independent reports.
I would still ask the S75 team to review. I'm sure HSBC will have done everything they can through the regs.
