    I'm not sure why you're hell bent on proving me wrong here but to clarify, I could upgrade to whatever contract duration I wanted, the decision had no stipulation other than to upgrade without penalty.

    im not trying to "prove you wrong" merely suggesting that they may not have a case to answer, and you might just have to pay the money they say you owe them.

    In your OP you said

    I answered your question saying no i dont believe it is correct and it appears o2 believe the same.

    I have never heard of an "upgrade" reducing the term of a contract, in fact the reason phone companys give upgrades normally at a good deal is to tie you in for longer, They were allowing you to upgrade your contract to take advantage of 4G, however I dont see where they agreed or where told to let you leave early, I think that point is crucial,

    now i know you say you would call it an upgrade to switch to simplicity, however in my experience when my contract has been up but i wanted to wait for a new handset, they would switch to a sim only tariff until such times as I wanted to upgrade,

    It will be interesting to see the ombudsmans take on it, and i genuinely hope you are right, but i think the crucial point is they didnt say you could exit your contract early without penalty
